Se’if 1א׳

דין התופס לבעל חוב במקום שחב לאחרים ונפקד שתפס הפקדון בשביל הבעל חוב. ובו ו סעיפים: הלוה שחייב לשנים או יותר ואין לו כדי לפרוע לכולם וקדם אדם א' ותפס מהמטלטלים של לוה כדי לזכות לאחד מבעלי חובות לא זכה שכל התופס לב"ח במקום שיש עליו חוב לאחרים לא קנה ואפי' עשאו שליח וכתב לו הרשאה אבל אפוטרופוס קנה דיד בעלים הוא:

The law of one who seizes for a creditor where he thereby causes loss to others; and a bailee who seized the deposit for the creditor; it contains six se'ifim. A borrower who owes two or more and has not enough to repay all of them, and a man went first and seized some of the borrower's movables in order to acquire them for one of the creditors — he has not acquired; for anyone who seizes for a creditor where the debtor owes a debt to others has not acquired, even if he made him an agent and wrote him a power of attorney. But a guardian acquires, for he is the owner's hand.

Se’if 2ב׳

אם הלוה חייב גם לתופס זכה בתפיסתו מגו דאי בעי זכי לנפשיה זכי לחבריה:

If the borrower owes the seizer too, he has acquired by his seizure: since, had he wished, he could acquire for himself, he can acquire for his fellow.

Se’if 3ג׳

אם הלוה אמר לאדם אחד זכה בחפץ זה לפלוני או תן מנה זה לפלוני זכה לו ואפי' אין הזוכה מכיר לאותו פלוני ואין אחד מבעלי חובות יכולים לגבות מאלו שכבר זכה בהם אחר:

If the borrower said to a man, "Acquire this article for so-and-so", or "Give this maneh to so-and-so", he has acquired for him, even if the one acquiring does not know that so-and-so; and none of the creditors can collect from these, since another has already acquired them.
