דין ב"ח מאוחר שקדם וגבה מקרקעי או מטלטלי ומלוה ע"פ מוקדמת קודמת למלוה בשטר. ובו טז סעיפים: מי שיש עליו בעלי חובות הרבה כל מי שקדם זמן קנין של שטרו קודם הוא לגבות בין קרקע בין מטלטלים אפי' אם הגיע זמן פרעון של המאוחר קודם בין מלוה עצמו בין מלקוחות ואם קדם המאוחר וגבה קרקע אפי' הגבו לו בפני המוקדם ושתק מוציאין מידו: הגה מיהו כשבא לגבות גובין לו וכשיבא זמן הראשון לגבות יטרוף ממנו ודוקא כשבא לגבות מקרקע אבל כשבא לגבות מטלטלין יוכל בעל חוב הראשון לטעון שלא להגבותם פן יבריחם או יפסידם ועוד דאם יגבה המאוחר שוב לא יכול המוקדם להוציא ממנו אבל אם הלוה עצמו נותנם לו י"א דאין בעל חוב המוקדם יכול למחות (תשובת רשב"א אלף קי"א) וכל זה במלוה בשטר אבל מלוה על פה אם קדם המאוחר וגבה מה שגבה גבה (ר"ן פ' מי שהיה נשוי) אלא אם כן גבה בעל חוב מאוחר בינונית והניח זיבורית לב"ח מוקדם דאז מה שגבה גבה ואם מכרם קודם שהספיק הראשון להוציאם מידו אין המוקדם חוזר עליו אפילו אם המעות עדיין בידו אלא חוזר על הלקוחות ששעבודו בידם ואם מכרם לעכו"ם שאינו יכול להוציאם מידו חייב לשלם לו אפילו אין המעות בידו מדינא דגרמי וכן אם הניח בע"ח מאוחר מטלטלין לבע"ח מוקדם מה שגבה גבה: הגה יש אומרים דבדבר שאינו עתה בעולם ועתיד לבא אח"כ לא שייך ביה דין קדימה ואם קודם שבא הדבר לעולם נשבע לתת אותו לבעל חוב מאוחר צריך לקיים שבועתו (תשובת חזה התנופה והביאו הטור סי' צ"ט ס"ו) וע' לעיל סי' צ"ט סעיף ב':

The law of a later creditor who went first and collected land or movables; and an earlier loan by word of mouth comes before a loan by document; it contains sixteen se'ifim. One who has many creditors upon him: whoever's document has the earlier date of kinyan (a formal act of acquisition) comes first to collect, whether land or movables, even if the term of repayment of the later one arrived first — whether from the borrower himself or from purchasers. And if the later one went first and collected land, even if they had it collected for him in the presence of the earlier one and he was silent, they take it out of his hand. Hagah [Rema]: However, when he comes to collect, they collect for him; and when the term of the first arrives for collection, he will seize it from him. And this is specifically when he comes to collect from land; but when he comes to collect movables, the first creditor can plead that they should not be collected for him, lest he put them beyond reach or lose them; and moreover, if the later one collects, the earlier can no longer take them out of his hand. But if the borrower himself gives them to him, some say the earlier creditor cannot protest (responsum of the Rashba, siman 1111). And all this is with a loan by document; but with a loan by word of mouth, if the later one went first and collected, what he has collected he has collected (the Ran, chapter "One who was married"); unless the later creditor collected middling land and left the poorest land for the earlier creditor, for then what he has collected he has collected. And if he sold them before the first managed to take them out of his hand, the earlier one does not go back against him, even if the money is still in his hand; rather, he goes back against the purchasers, in whose hands his lien is. And if he sold them to a gentile, from whom he cannot take them out, he must pay him, even if the money is not in his hand, under the law of garmi (liability for damage one causes indirectly). And likewise, if the later creditor left movables for the earlier creditor, what he has collected he has collected. Hagah [Rema]: Some say that with a thing that is not yet in the world and will come later, the law of precedence does not apply to it; and if, before the thing came into the world, he swore to give it to the later creditor, he must fulfil his oath (responsum of Chazeh haTenufah, brought by the Tur, siman 99, se'if 6); and see above, siman 99, se'if 2.

בעל חוב שגבה חובו מבתי שמעון בכתב שלטון העיר שעשו הכרזה יום אחד ואח"כ בא בע"ח (המוקדם) להוציא ממנו וטוען המאוחר כיון שלא ערערת בשעת הכרזה הפסדת בכך אם היה הכרוז יוצא כל מי שיש לו זכות ושעבוד על קרקע זה יבא ויערער וכל מי שלא יערער יבטלו זכיותיו אם נהגו כן דינא דמלכותא הוא ובטלו זכיותיו: הגה והוא הדין אם היו הבעלי חוב חלוקים וצוו להשכין או לעקל נכסי הלוה ולא ידענו מי הקודם והשוטר מעיד כדברי האחד נאמן מכח דינא דמלכותא אם המנהג כן (ב"י בשם תשו' שבסוף חזה התנופה וע"ל ס"ט שס"ט) וכן אם האחד גבה והשני טוען עליו שגבה שלא כדין ושלא היה חייב לו הואיל וגובה על פי דינא דמלכותא מה שגבה גבה (ת' הרשב"א סי' תתקמ"ו) אבל אם בסתם הכריזו כל מי שיש לו זכות יבא ויערער לא בטלו זכיותיו בשביל שלא ערער: הגה ואם הכריזו שכל מי שלא יבא יאבד זכיותיו ואחד טען שלא שמע ההכרזה מהני טענה שלו ולא אמרינן חברא חברא אית ליה (תשובות רשב"א סי' תתנ"ג):

A creditor who collected his debt from Shimon's houses by a writ of the ruler of the city, where they made a public announcement for one day, and afterwards the (earlier) creditor came to take it out of his hand, and the later one pleads, "Since you did not protest at the time of the announcement, you have lost by it": if the herald's proclamation went out, "Whoever has any right or lien on this land, let him come and protest, and whoever does not protest, his rights will be void" — if they were accustomed so, it is the law of the kingdom, and his rights are void. Hagah [Rema]: And the same applies if the creditors were in dispute, and they ordered the borrower's property to be distrained or attached, and we do not know which is earlier, and the officer testifies in accordance with the words of one of them — he is believed, by force of the law of the kingdom, if the custom is so (Beit Yosef in the name of the responsa at the end of Chazeh haTenufah; and see below, siman 369, se'if 9). And likewise, if one collected and the second pleads against him that he collected not according to law and that the borrower did not owe him — since he collects by the law of the kingdom, what he has collected he has collected (responsum of the Rashba, siman 946). But if they announced without specifying, "Whoever has any right, let him come and protest", his rights are not void because he did not protest. Hagah [Rema]: And if they announced that whoever does not come will lose his rights, and one pleaded that he did not hear the announcement, his plea avails, and we do not say, "Your friend has a friend" (responsa of the Rashba, siman 953).

Se’if 3ג׳

במטלטלין וכן עבדים אין בהם דין קדימה לענין שאם קדם המאוחר וגבה אין מוציאין מידו ולא עוד אלא שאם עמד הראשון ותפסם הב"ח המאוחר שקדם וגבה מוציא אותם בב"ד מידו: (מיהו אם תפס שטרות אפי' המוקדם לא הוי כתפס הממון ויחלוקו (רבינו ירוחם נתיב כ"ו חלק ג') .

With movables, and likewise slaves, there is no law of precedence, in the sense that if the later one went first and collected, they do not take it out of his hand. And not only that, but if the first stood up and seized them, the later creditor who went first and collected takes them out of his hand through the court. (However, if he seized documents, even the earlier one, it is not as seizing money, and they divide) (Rabbeinu Yerucham, netiv 26, part 3).
