Se’if 1א׳
שמין קרקע של לוה ואם טעו בשומא ושומא הדרה לעולם. ובו יא סעיפים: כששמין השלשה שמאין קרקע הלוה אין שמין אלא כפי הזמן וכפי השעה שנמכרים הקרקעות אז באותו מקום: הגה ואם אין הקרקע מגיע לו כולה כגון שאין לו בחוב אלא מנה והקרקע ביחד נישומת בחמש מאות זהובים אין אומרים לו תן לו חמישית הקרקע אלא שמין כמה שיכול למכור מזאת הקרקע או הבית בק' זהובים ונותנין למלוה כללו של דבר אין שמין לו אלא דבר שיכול למכור מיד ולגבות חובו ואין חוששין להפסד הלוה (תשובת הרא"ש כלל פ' סי' ט') (וע' לקמן סעיף ה') ואח"כ מכריזין עליה כפי מה שיראו עד שיפסקו המוסיפים ואם קרקע זה היה טורף המלוה מהלקוחות צריכים להכריז עליה שלשים יום כדרך שמכריזין על נכסי יתומים (ועיין לקמן ר"ס ק"ט) ובאים הלוקחים וקוצבים דמים כרצונם אם מצאו בה כשומת ב"ד או יתר לוקחים הדמים ונותנים אותם למלוה ואם רצה המלוה לקחתה באותו סך הוא קודם ואם לא מצאו בה כדי שומתן מחליטין אותם למלוה בכדי שומתן: הגה ויש חולקין וסבירא להו דהוא הדין אם בא לגבות מבני חרי כיון שנמכר שלא מדעתו בב"ד צריך שומא והכרזה כמו בשל יתומים (טור וב"י בשם התרומות):
They appraise the borrower's land; and if they erred in the appraisal; and the appraisal reverts for ever; it contains eleven se'ifim. When the three appraisers appraise the borrower's land, they appraise only according to the time and according to the hour at which land is sold then in that place. Hagah [Rema]: And if the land does not all come to him — for instance, he has only a maneh in the debt, and the land together is appraised at five hundred gold coins — they do not say, "Give him a fifth of the land"; rather, they appraise how much of this land or house could be sold for a hundred gold coins, and give it to the lender. The rule of the matter: they appraise for him only a thing that he can sell at once and collect his debt, and they have no concern for the borrower's loss (responsum of the Rosh, klal 80, siman 9) (and see below, se'if 5). And afterwards they announce it publicly, according to what they see fit, until the bidders stop adding. And if this land was one that the lender was seizing from the purchasers, they must announce it for thirty days, in the way they announce the property of orphans (and see below, beginning of siman 109); and the buyers come and set prices as they wish. If they found in it the court's appraisal or more, they take the money and give it to the lender; and if the lender wishes to take it at that sum, he comes first; and if they did not find in it as much as their appraisal, they assign it outright to the lender at their appraisal. Hagah [Rema]: And some disagree and hold that the same applies if he comes to collect from unencumbered property: since it is sold through the court without his consent, it needs appraisal and public announcement, as with that of orphans (Tur and Beit Yosef in the name of the Terumot).

שלשה שירדו לשום אחד אומר במנה ושנים אומרים במאתים או אחד אומר בק"ק ושנים אומרים במנה בטל יחיד במיעוטו אחד אומר במנה ואחד אומר בשמנים ואחד אומר בק"כ נידון בק' מפני שאנו ממצעים מה שיש בין המועט למרובה ומוסיפין על המועט המחצית וגורעין מהמרובה המחצית וכיון שבין האומר שמנים לאומר ק"כ יש ארבעים כשאתה מוסיף על המועט המחצית וגורעין מהמרובה המחצית נמצא שהוא נידון במאה ולפי זה אם אחד אומר במנה וא' אומר בצ' וא' אומר בק"ל נידון בק"י ועל דרך זו שמין ביניהם לעולם:
Three who went down to appraise: one says a maneh and two say two hundred, or one says two hundred and two say a maneh — the individual is nullified by his minority. One says a maneh, and one says eighty, and one says a hundred and twenty — it is judged at a hundred, because we take the middle of what lies between the smaller and the greater: we add half to the smaller and take half off the greater; and since between the one who says eighty and the one who says a hundred and twenty there are forty, when you add half to the smaller and take half off the greater, it is found to be judged at a hundred. And accordingly, if one says a maneh, and one says ninety, and one says a hundred and thirty, it is judged at a hundred and ten; and in this way they always appraise between them.

שמאוה שלשה ואומר המלוה ישומו אותה שלשה אחרים הבקיאים יותר בשומא אין שומעין לו: הגה ויכולין אלו שלשה השמאים להיות קרובים זה לזה (כן כתב הר"י בן הרא"ש):
Three appraised it, and the lender says, "Let three others, more expert in appraisal, appraise it" — they do not listen to him. Hagah [Rema]: And these three appraisers may be relatives of one another (so wrote Rabbi Yehudah son of the Rosh).
