Se’if 1א׳
מאיזה קרקע מגבין החוב לבעה"ח. ובו ה סעיפים: בא המלוה לגבות קרקע מגבין לו מן הבינונית שבנכסי הלוה דבשלו הם שמין:
From which land the debt is collected for the creditor; it contains five se'ifim. The lender came to collect land: they collect for him from the middling land in the borrower's property, for it is by his that they appraise.
Se’if 2ב׳
היו לו שלשה או ארבע שדות בינונית לא יוכל המלוה לומר תן לי משדה פלונית שהיא חביבה עלי אלא ברשות הלוה הוא ליתן לו מאיזה שירצה אם חפץ המלוה בזיבורית ואומר לו תן לי זיבורית טפי פורתא שומעים לו ונוטלים בזילא דהשתא ולא ביוקרא דלקמיה: הגה וי"א דאין כופין אותו ליתן לו זיבורית אלא אם רוצה ליתן לו ביוקרא דלקמיה כופין אותו ליתן לו בזולא דהשתא (טור בשם הרא"ש):
If he had three or four fields of middling land, the lender cannot say, "Give me from such-and-such a field, which is dear to me"; rather, it is in the borrower's power to give him from whichever he wishes. If the lender wants the poorest land and says to him, "Give me the poorest land, a little more", they listen to him, and they take it at today's cheaper price and not at the dearer price of later. Hagah [Rema]: And some say that they do not compel him to give him the poorest land; but if he wishes to give it to him at the dearer price of later, they compel him to give it to him at today's cheaper price (Tur in the name of the Rosh).
Se’if 3ג׳
אם אומר המלוה תן לי עידית בציר פורתא (פי' מעט פחות) אין כופין אותו ליתנה לו אפי' ביוקרא דלקמיה אם אין ללוה אלא עידית אינו יכול למכרה ולקנות בינונית להגבות לבעל חובו אלא מגבין לו מהעידית ואפי' יש לו עידית במקומו ובינונית במקום אחר א"י לומר לו שיטול מהבינונית שיש לו במקום אחר אלא צריך ליתן לו מעידית שבמקום הבעל חוב:
If the lender says, "Give me choice land, betzir purta" (that is, a little less), they do not compel him to give it to him, even at the dearer price of later. If the borrower has only choice land, he cannot sell it and buy middling land to have it collected by his creditor; rather, they collect for him from the choice land. And even if he has choice land in his own place and middling land in another place, he cannot tell him to take from the middling land that he has in the other place; rather, he must give him from the choice land that is in the creditor's place.
