Plaintiff and Defendant· siman 101

Choshen Mishpat is set from the Lemberg 1898 edition, which is unpointed, so the vowels switch has nothing to remove here.

Se’if 1א׳

They collect money or movables for a creditor; and if he ascribed his money to a gentile; and if he has debts to gentiles; it contains eleven se'ifim. When the borrower comes to pay, if he has money he must give it to him, and cannot put him off onto land or movables. And if it is not known to us that he has money, they do not make him swear; and even if we see that he has money and he says, "It is not mine but so-and-so's", we do not make him swear; but they pronounce a cherem (the severer form of the ban) on whoever knows that he has money. And where he said, "I have no money", and was found a liar, he is no longer believed in this debt if he says, "I have no money"; rather, he must take the trouble to sell and bring money. Hagah [Rema]: And likewise, if it seems to the court that he is lying, and has money, and does not wish to pay, they compel him to pay money (Tur); and see below, se'ifim 7 and 8.

Se’if 2ב׳

If he has no money, he need not sell in order to give him money; rather, he gives him from what he has. And if he has movables and land, and the lender wants movables more than land, he must give him movables; only that he gives him from whichever movables he himself wishes, and the lender cannot say, "I do not want this movable, but that one".

Se’if 3ג׳

If he has money and land, or money and movables, and the borrower says he will repay him in money, the lender cannot say, "I do not want money, but land or movables". (And likewise) if there is no money there but land and movables, and the borrower wishes to give him movables, the lender cannot say, "I want only land".

…and 6 more se'ifim in this siman.
