Halacha 1א׳

חֲלוּצֵי צָבָא כְּשֶׁיִּכָּנְסוּ בִּגְבוּל הָעַכּוּ"ם וְיִכְבְּשׁוּם וְיִשְׁבּוּ מֵהֶן. מֻתָּר לָהֶן לֶאֱכל נְבֵלוֹת וּטְרֵפוֹת וּבְשַׂר חֲזִיר וְכַיּוֹצֵא בּוֹ אִם יִרְעַב וְלֹא מָצָא מַה יֹּאכַל אֶלָּא מַאֲכָלוֹת אֵלּוּ הָאֲסוּרִים. וְכֵן שׁוֹתֶה יֵין נֶסֶךְ. מִפִּי הַשְּׁמוּעָה לָמְדוּ וּבָתִּים מְלֵאִים כָּל טוּב עָרְפֵּי חֲזִירִים וְכַיּוֹצֵא בָּהֶן:

Soldiers girt for war, when they enter the border of the gentiles and conquer them and take captives of them, are permitted to eat carcasses, and terefah, and the flesh of swine and the like of it, if a man is hungry and finds nothing to eat but these forbidden foods. And so too he drinks wine of libation. From tradition they learned, "and houses full of all good things" — the necks of swine and the like of them.

Halacha 2ב׳

וְכֵן בּוֹעֵל אִשָּׁה בְּגֵיוּתָהּ אִם תְּקָפוֹ יִצְרוֹ. אֲבָל לֹא יִבְעָלֶנָּה וְיֵלֵךְ לוֹ. אֶלָּא מַכְנִיסָהּ לְתוֹךְ בֵּיתוֹ. שֶׁנֶּאֱמַר (דברים כא, יא) "וְרָאִיתָ בַּשִּׁבְיָה אֵשֶׁת יְפַת תֹּאַר". וְאָסוּר לִבְעל אוֹתָהּ בִּיאָה שְׁנִיָּה עַד שֶׁיִּשָּׂאֶנָּה:

And so too he may have relations with a woman while she is still a gentile, if his impulse has overcome him. But he shall not have relations with her and go his way; rather he brings her into his house, as it is said (Deuteronomy 21:11), "and you see among the captives a woman of beautiful form." And it is forbidden to have relations with her a second time until he marries her.

Halacha 3ג׳

אֵין אֵשֶׁת יְפַת תֹּאַר מֻתֶּרֶת אֶלָּא בִּשְׁעַת הַשִּׁבְיָה. שֶׁנֶּאֱמַר (דברים כא, יא) "וְרָאִיתָ בַּשִּׁבְיָה". בֵּין בְּתוּלָה בֵּין בְּעוּלָה בֵּין אֵשֶׁת אִישׁ. שֶׁאֵין אִישׁוּת לְעַכּוּ"ם. וְחָשַׁקְתָּ אַף עַל פִּי שֶׁאֵינָהּ יָפָה. בָהּ וְלֹא בַּחֲבֶרְתָּהּ שֶׁלֹּא יִבְעל שְׁתַּיִם. וְלָקַחְתָּ לְךָ לְאִשָּׁה שֶׁלֹּא יִקַּח שְׁתַּיִם וְיִבְעל אַחַת וְיַנִּיחַ אַחַת לְאָבִיו אוֹ לְאָחִיו. וּמִנַּיִן שֶׁלֹּא יִלְחָצֶנָּה בַּמִּלְחָמָה. שֶׁנֶּאֱמַר (דברים כא, יב) "וַהֲבֵאתָהּ אֶל תּוֹךְ בֵּיתֶךָ". יַכְנִיסָהּ לְמָקוֹם וְאַחַר כָּךְ יִבְעל:

A woman of beautiful form is permitted only at the hour of the captivity, as it is said (Deuteronomy 21:11), "and you see among the captives" — whether a virgin or one who has known a man, and whether married or not, for there is no marriage-bond for a gentile. "And you desire her" — even though she is not beautiful. "Her," and not her fellow — that he shall not have relations with two. "And you take her to yourself for a wife" — that he shall not take two and have relations with one and leave one for his father or for his brother. And whence that he shall not press her in the war? As it is said (Deuteronomy 21:12), "and you shall bring her into the midst of your house" — let him bring her into a place, and afterwards have relations.
