Mishnah

משנה: אֵין נוֹתְנִין דְּבֵילָה וּגְרוֹגְרוֹת לְתוֹךְ הַמּוּרִיֵּיס מִפְּנֵי שֶׁהוּא מְאַבְּדָן אֲבָל נוֹתְנִין אֶת הַיַּיִן לְמוּרִיֵּיס וְאֵין מְפַטְּמִין אֶת הַשֶּׁמֶן אֲבָל עוֹשִׂין אֶת הַיַּיִן יֵינוֹמֵילִין. אֵין מְבַשְּׁלִין יַיִן שֶׁל תְּרוּמָה מִפְּנֵי שֶׁהוּא מַמְעִיטוֹ. רִבִּי יְהוּדָה מַתִּיר מִפְּנֵי שֶׁהוּא מַשְׁבִּיחוֹ.

MISHNAH: One does not put a fig cake or figs into muries because he would destroy them but one may add wine to muries. One does not use olive oil as base for perfume but one may use wine as base for ὀινόμελι. One may not cook heave wine because he diminishes it; Rebbi Jehudah permits it because he improves it.

הלכה: אֵין נוֹתְנִין דְּבֵילָה וּגְרוֹגְרוֹת לְתוֹךְ הַמּוּרִיֵּיס כו׳. תַּנֵּי נוֹתֵן דְּבֵילָה וּגְרוֹגְרוֹת לְתוֹךְ הַמּוּרִיֵּיס כְּדֶרֶךְ שֶׁנּוֹתֵן תַּבְלִין וּבִלְבָד שֶׁלֹּא יִסְחֲטֵם לְהוֹצִיא מֵימֵיהֶם. וּבְתַבְלִין מוּתָּר שֶׁכָּךְ הוּא מְלָאכְתָן. צְרוֹר תַּבְלִין שֶׁנְּתָנוֹ לְתוֹךְ קְדֵירָה זוֹ וְחָזַר וּנְתָנוֹ לְתוֹךְ קְדֵירָה אֲחֶרֶת אִם בָּטֵל טַעֲמוֹ מוּתָּר וְאִם לָאו אָסוּר.

HALAKHAH: “One does not put fig cake or figs into muries”, etc. It was stated: “One puts fig cake or figs into muries in the way one uses spices on condition he not squeeze them to extract their juice. But spices are permitted, for that is what they are used for. A bundle of spices put into one pot and then transferred to another, if their taste is lost they are permitted, otherwise forbidden.”

מַה בֵּינָהּ לְבֵין שֶׁבֶת. לֹא כֵן תַּנֵּי הַשֶּׁבֶת שֶׁנָּתַן טַעַם בִּקְדֵירָה אֵין בָּהּ מִשּׁוּם תְּרוּמָה. וְאֵינָהּ מְטַמְּאָה טוּמְאַת אוֹכְלִין. מִשֶּׁלָּךְ נָתְנוּ לָךְ בְּדִין הָיָה שֶׁלֹּא תְּטַמֵּא טוּמְאַת אוֹכְלִין וְהֵן אָמְרוּ שֶׁתְּטַמֵּא טוּמְאַת אוֹכְלִין. וְהֵן אָמְרוּ מִכֵּיוָן שֶׁנָּתְנָה טַעַם בִּקְדֵירָה בָּטְלָה.

What is the difference between this and dill? Did we not state: “Dill which gave its taste [to a dish] in a pot no longer is under the rules of heave and does not accept the impurity of food.” They gave to you from your own. From biblical law it should not accept the impurity of foodstuffs; they said that it should accept the impurity of foodstuffs and they said that after it transferred its taste it is disregarded.

רִבִּי חִיָיה בְשֵׁם רִבִּי יוֹחָנָן דְּרִבִּי הִיא דְּתַנֵּי יַיִן לְמוּרִיֵּיס רִבִּי מַתִּיר וְרִבִּי אֶלְעָזָר בֵּי רִבִּי שִׁמְעוֹן אוֹסֵר. לְפִיכָךְ אִם עָבַר וּנְתָנוֹ רִבִּי אוֹסֵר לְזָרִים. וְרִבִּי אֶלְעָזָר בֵּי רִבִּי שִׁמְעוֹן מַתִּיר לְזָרִים.

Rebbi Ḥiyya in the name of Rebbi Joḥanan: This is Rebbi’s, as we have stated: “Wine in muries, Rebbi permits but Rebbi Eleazar ben Rebbi Simeon forbids. Therefore, if somebody transgressed and put it in, Rebbi forbids it to laymen but Rebbi Eleazar ben Rebbi Simeon permits to laymen.”

רִבִּי מָנָא בְּרִבִּי תַנְחוּם בָּעֵי כְּדִבְרֵי מִי שֶׁמַּתִּיר לְזָרִים. מוּרִיֵּיס שֶׁל גּוֹיִם לָמָּה אָסוּר. רִבִּי יִרְמְיָה בְשֵׁם רִבִּי חִיָיא בַּר וָוא מִשּׁוּם בִּישּׁוּלֵי גוֹיִם הֵן אֲסוּרִין. הָתִיב רִבִּי יוֹסֵי וְהָתַנֵּי חמין מוּתָּר וּשֶׁאֵינוֹ חמין אָסוּר. חמין מוּתָּר לֹא אֲפִילוּ מְבוּשָּׁל וְדִכְוָותָהּ וּשֶׁאֵינוֹ חמין אָסוּר וַאֲפִילוּ שֶׁאֵינוֹ מְבוּשָּׁל. וְאָמַר רִבִּי יוֹחָנָן בַּר מַרְיָה וַאֲפִילוּ כְּמָאן דְּאָמַר חמין מוּתָּר וּבִלְבַד בְיוֹדֵעַ. הָדָא אָמְרָה הֲנָיַית תְּרוּמָה מוּתֶּרֶת. הֲנָיַית עֲבוֹדָה זָרָה אֲסוּרָה.

Rebbi Mana ben Rebbi Tanḥum asked: Following him who permits to laymen, why is muries of Gentiles forbidden? Rebbi Jeremiah in the name of Rebbi Ḥiyya bar Abba, it is forbidden as being cooked by Gentiles. Rebbi Yose objected: Did we not state: “From a professional it is permitted, not from a professional it is forbidden.” From a professional it is permitted even if it is cooked; similarly, from a non-professional it is forbidden even if not cooked. Rebbi Joḥanan bar Maria said, even according to him who says from a professional it is permitted, only if he knows. This implies that usufruct of heave is permitted, usufruct of paganism is forbidden.

רִבִּי לָעְזָר וְרִבִּי יוֹחָנָן חַד אָמַר מִפְּנֵי שֶׁמְּמַעֲטוֹ מִמִּידָּתוֹ. וְחָרָנָה אָמַר מִפְּנֵי שֶׁמְּמַעֲטוֹ מִשּׁוֹתָיו. וְלֹא יָדְעִין מָאן אָמַר דָּא וּמָאן אָמַר דָּא. מִן מַה דְאָמַר רִבִּי יוֹחָנָן מִחְלְפָה שִׁיטָּתֵיהּ דְּרִבִּי יְהוּדָה. וְאָמַר רִבִּי לָעְזָר אֵינָהּ מוּחְלֶפֶת תַּמָּן בְּכֹהֵן וְכָאן בְּבַעְלִים. הֲוֵי רִבִּי יוֹחָנָן הוּא דְאָמַר מִפְּנֵי שֶׁמְּמַעֲטוֹ מִשּׁוֹתָיו.

Rebbi Eleazar and Rebbi Joḥanan, one of them said because he diminishes its volume, the other says because he reduces the number of drinkers. We did not know who said what. Since Rebbi Joḥanan said, Rebbi Jehudah inverted his reasoning but Rebbi Eleazar said, Rebbi Jehudah did not invert his reasoning, there for the Cohen, here for the owners, it follows that Rebbi Joḥanan said because he reduces the number of drinkers.

יְהוּדָה בֶּן כֵּינִי רִבִּי אִימִּי בְשֵׁם רִבִּי שִׁמְעוֹן בֶּן לָקִישׁ מִפְּנֵי שֶׁמְּמַעֲטוֹ מִשּׁוֹתָיו.

Jehudah ben Keni, Rebbi Ammi in the name of Rebbi Simeon ben Laqish: Because he reduces the number of drinkers.

משנה: דְּבַשׁ תְּמָרִים וְיֵין תַּפּוּחִין וְחוֹמֶץ סִיתְוָונִיּוֹת וּשְׁאָר כָּל מֵי פֵּירוֹת שֶׁל תְּרוּמָה. רִבִּי לִיעֶזֶר מְחַיֵיב קֶרֶן וְחוֹמֶשׁ. וְרִבִּי יְהוֹשֻׁעַ פּוֹטֵר. רִבִּי לִיעֶזֶר מְטַמֵּא מִשּׁוּם מַשְׁקֶה אָמַר רִבִּי יְהוֹשֻׁעַ אוֹמֵר לֹא מָנוּ חֲכָמִים שִׁבְעָה מַשְׁקִין כְּמוֹנֵי פַטָּמִין אֶלָּא אָמְרוּ שִׁבְעָה מַשְׁקִין טְמֵאִין וּשְׁאָר כָּל הַמַּשְׁקִין טְהוֹרִין.

MISHNAH: Date honey, apple wine, vinegar from winter grapes, and any other fruit juices from heave, Rebbi Eliezer subjects to [repayment of] value and fifth, but Rebbi Joshua frees [from payment]. Rebbi Eliezer declares them impure as drinks. Rebbi Joshua said, the Sages did not enumerate seven fluids as one counts raw materials for perfumes but they said, seven fluids are impure, all other fluids are pure.

הלכה: הֲווֹן בָּעֵיי מֵימַר מַה פְלִיגִין בְּחוֹמֶשׁ אֲבָל בְקֶרֶן אַף רִבִּי יְהוֹשֻׁעַ מוֹדֵי. מַה פְלִיגִין לְשֶׁעָבַר הָא בַתְּחִילָּה אַף רִבִּי יוֹשׁוּעַ מוֹדֵה. וְתַנִּינָן דְּבַשׁ תְּמָרִים רִבִּי לִיעֶזֶר מְחַיֵיב בְּמַעְשְׂרוֹת וְרִבִּי יְהוֹשֻׁעַ פּוֹטֵר. כָּאן שֶׁזָּבוּ מִשֶּׁנִּטְבְּלוּ. וְכָאן שֶׁזָּבוּ עַד שֶׁלֹּא נִטְבְּלוּ.

HALAKHAH: They want to say that they differ about the fifth but Rebbi Joshua agrees about the principal. They differ after the fact, but before the fact Rebbi Joshua agrees. But we have stated: “Rebbi Eliezer subjects date honey to tithes, but Rebbi Joshua frees it.” Here, when they obtained it after it became ṭevel, there before it became ṭevel.

מוֹדֵי רִבִּי לִיעֶזֶר שֶׁאִם עִישֵּׂר עַל הַתְּמָרִים אֲפִילוּ בְּאִיסְפָּמִיָּא דִּבְשָׁן מוּתָּר. מִילְתֵיהּ אָמְרָה שֶׁהוּא מְעַשֵּׂר מִן הַתְּמָרִים עַל הַדְּבָשׁ לְפִי תְּמָרִים. רִבִּי לִיעֶזֶר מְחַיֵיב בְּמַעְשְׂרוֹת. תַּנֵּי רִבִּי נָתָן אוֹמֵר לֹא שֶׁרִבִּי לִיעֶזֶר מְחַיֵיב בְּמַעְשְׂרוֹת אֶלָּא שֶׁרִבִּי לִיעֶזֶר אוֹמֵר שֶׁלֹּא יֹאכַל מִן הַתְּמָרִים עַד שֶׁיְּעַשֵּׂר עַל הַדְּבָשׁ. מִילְתֵיהּ אָמַר שֶׁהוּא מְעַשֵּׂר מִן הַתְּמָרִים עַל הַדְּבָשׁ לְפִי דְבָשׁ וּלְפִי תְּמָרִים.

Rebbi Eliezer agrees that if he tithed the dates, their honey is permitted even in Spain. This implies that he tithes dates including honey proportional to the dates. “Rebbi Eliezer subjects date honey to tithes.” We have stated: “Rebbi Nathan says, not that Rebbi Eliezer subjects it to tithes but Rebbi Eliezer says he should not eat from the tithes until he also tithed the honey.” This implies that he tithes dates including honey proportional to honey and dates.

רִבִּי לִיעֶזֶר מְטַמֵּא מִשּׁוּם מַשְׁקֶה. תַּנֵּי רִבִּי נָתָן אוֹמֵר לֹא שֶׁרִבִּי לִיעֶזֶר מְטַמֵּא מִשּׁוּם מַשְׁקֶה עַל מַה נֶחְלְקוּ עַל שֶׁנָּפַל לְתוֹכוֹ מַשְׁקֶה. שֶׁרִבִּי לִיעֶזֶר מְטַמֵּא מִשּׁוּם מַשְׁקֶה. וַחֲכָמִים אוֹמְרִים הוֹלְכִין אַחַר הָרוֹב.

“Rebbi Eliezer declares it impure as drink.” It was stated: “Rebbi Nathan said, Rebbi Eliezer does not declare it impure as drink; what did they disagree about? If some drink fell into it, then Rebbi Eliezer declares it impure as drink but the Sages say, it follows the majority.”

עַל דַּעְתֵּיהּ דְּרִבִּי נָתָן רִבִּי מֵאִיר וְרִבִּי לִיעֶזֶר בֶּן יַעֲקֹב וְרִבִּי לִיעֶזֶר שְׁלָשְׁתָּן אָמְרוּ דָבָר אֶחָד. רִבִּי מֵאִיר דּוּ אָמַר אֵין מֵי פֵּירוֹת בְּטֵילִין לְעוֹלָם. רִבִּי לִיעֶזֶר בֶּן יַעֲקֹב דְּתַנֵּי רִבִּי לִיעֶזֶר בֶּן יַעֲקֹב אוֹמֵר צִיר טָהוֹר שֶׁנָּפַל לְתוֹכוֹ מַיִם כָּל שֶׁהוּא טָמֵא. וְהָדֵין רִבִּי לִיעֶזֶר דְּהָכָא.

In the opinion of Rebbi Nathan, Rebbi Meїr, Rebbi Eliezer ben Jacob, and Rebbi Eliezer, all three said the same. Rebbi Meїr, for he says, “fruit juice never is disregarded.” Rebbi Eliezer ben Jacob as we have stated: “Pure fish sauce into which fell the smallest amount of water is impure.” And Rebbi Eliezer here.

טַעֲמָא דְּרִבִּי לִיעֶזֶר וְכָל מַשְׁקֶה. מַה טַעֲמָא דְּרַבָּנִין אֲשֶׁר יִשָּׁתֶה. מַה רִבִּי לִיעֶזֶר כְּרִבִּי יִשְׁמָעֵאל דְּרִבִּי יִשְׁמָעֵאל דּוּ אָמַר כְּלָל וּפְרָט הַכֹּל בִּכְלָל. וְרוּבָּה מִדְּרִבִּי יִשְׁמָעֵאל דּוּ אָמַר אֲפִילוּ כְּלָל וּפְרָט וְחָזַר וְכָלַל הַכֹּל בִּכְלָל. רִבִּי פֶּרִיגוֹרִי דְקַיְסָרִין אָמַר רִבִּי לִיעֶזֶר בֵּי רִבִּי יִשְׁמָעֵאל אֶלָּא כָּךְ מֵשִׁיב רִבִּי לִיעֶזֶר לַחֲכָמִים מַה דְאִית לְכוֹן אֲשֶׁר יֵאָכֵל פְּרָט לְאוֹכֶל סָרוּחַ. כֵּן אִית לִי אֲשֶׁר יִשָּׁתֶה פְּרָט לְמַשְׁקֶה סָרוּחַ. אָמַר לוֹ לֹא דוֹמִין אוֹכְלִין לְמַשְׁקִין. לֹא אִם אָמְרָת בְּאוֹכְלִין שֶׁכֵּן אוֹכֶל סָרוּחַ מֵעִיקָּרוֹ טָָהוֹר. תֹּאמַר בְּמַשְׁקִין שֶׁכֵּן מַשְׁקֶה סָרוּחַ מֵעִיקָּרוֹ טָמֵא. דָּבָר אַחֵר לֹא אִם אָמְרָת בְּאוֹכְלִין שֶׁכֵּן אוֹכְלִין הַמְּיוּחָדִין לְאָדָם אֵין צְרִיכִין מַחֲשָׁבָה. תֹּאמַר בְּמַשְׁקִין שֶׁכֵּן מַשְׁקִין הַמְּיוּחָדִין לְאָדָם צְרִיכִין מַחֲשָׁבָה. וּמִפְּנֵי שֶׁצְּרִיכִין מַחֲשָׁבָה יְהֵא מַשְׁקֶה סָרוּחַ מֵעִיקָּרוֹ טָמֵא. הוֹאִיל והֵן צְרִיכִין מַחֲשָׁבָה יְהֵא מַשְׁקֶה סָרוּחַ מֵעִיקָּרוֹ טָהוֹר. דָּבָר אַחֵר אָמְרוּ לוֹ לֹא אִם אָמְרָת בְּאוֹכְלִין שֶׁכֵּן אוֹכְלֵי בְהֵמָה לְאָדָם אֵינָן בָּאִין בְּמַחֲשָׁבָה. תֹּאמַר בְּמַשְׁקִין שֶׁכֵּן מַשְׁקֶה בְהֵמָה לְאָדָם בָּאִין בְּמַחֲשָׁבָה. וְתַנֵּי כֵן כָּל מַשְׁקֶה מַה תַלְמוּד לוֹמַר אֲשֶׁר יִשָּׁתֶה פְּרָט לְמַשְׁקֶה סָרוּחַ דִּבְרֵי רִבִּי לִיעֶזֶר. אָמְרוּ לֹו אֵין מַשְקִין יוֹצְאִין לֹא יְדֵי עוֹפוֹת וְלֹא יְדֵי פָרָה.

The reason of Rebbi Eliezer ( Lev. 11:34): “Any drink.” What is the reason of the rabbis? “That can be drunk.” Does Rebbi Eliezer hold with Rebbi Ismael, that for a particular statement after a general one, everything is included? He assumes more than Rebbi Ismael, in that even if there is a second general statement, all is included. Rebbi Paregoros from Caesarea: Rebbi Eliezer ben Rebbi Ismael said: So did Rebbi Eliezer answer the Sages: Since you interpret ( Lev. 11:34): “That can be eaten,” to exclude stinking food, so I hold “that can be drunk,” to exclude stinking drinks. They said to him, solid food and drinks are not comparable. If you argue about food, which is pure if stinking from the start, what can you infer for drinks since drinks stinking from the start can become impure? Another approach: If you argue about food, when human food does not need thinking about, what can you infer for drinks since human drink needs thinking about? Because they need thinking about them, should drinks stinking from the start become impure? Because they need thinking about them, drinks stinking from the start should be pure! Another approach. They said to him: If you argue about food, animal feed for humans is not created by thought, what can you infer for drinks since animal drinks for humans need thought? We have stated thus: ( Lev. 11:34) “Any drink,” why does the verse have to add “that can be drunk”? This excludes stinking drinks, the words of Rebbi Eliezer. They said to him, no drink is rejected by birds or a cow.

חֲבֵרַיָיא בְשֵׁם רִבִּי לָעְזָר מוֹדֶה רִבִּי לִיעֶזֶר לַחֲכָמִים בְּמַשְׁקֶה סָרוּחַ מֵעִיקָּרוֹ שֶׁהוּא טָמֵא. וְהָתַנִּינָן הַמּוֹהֵל הַיּוֹצֵא מֵהֶן רִבִּי לִיעֶזֶר מְטָהֵר וַחֲכָמִים מְטַמְּאִין. רִבִּי אִילָא בְשֵׁם רִבִּי לָעְזָר מוֹדֶה רִבִּי לִיעֶזֶר לַחֲכָמִים בְּמֵי יַם הַגָּדוֹל שֶׁאֲפִילוּ הֵן סְרוּחִין הַתּוֹרָה קָרָא אוֹתָן מַיִם. וּלְמִקְוֵה הַמַּיִם קָרָא יַמִּים. רִבִּי יַעֲקֹב בַּר זַבְדִּי בְשֵׁם רִבִּי אַבָּהוּ מוֹדֵי רִבִּי לִיעֶזֶר לַחֲכָמִים בְּמֵי תַּרְדִּין וּבְמֵי שְׂלָקוֹת שֶׁאֵינָן מַכְשִׁירִין.

The colleagues in the name of Rebbi Eleazar: Rebbi Eliezer agrees with the Sages that if a drink is stinking from the start it is impure. But did we not state: “The fluid oozing out from them Rebbi Eliezer declares pure but the Sages impure”? Rebbi Ila in the name of Rebbi Eleazar: Rebbi Eliezer agrees with the Sages about the waters of the ocean; even if they are stinking the Torah calls them water ( Gen. 1:10): “The collection of water He called oceans.” Rebbi Jacob bar Zavdi in the name of Rebbi Abbahu: Rebbi Eliezer agrees with the Sages that beet juice does not prepare.

רִבִּי יוֹחָנָן בְּשֵׁם רִבִּי שִׁמְעוֹן בֶּן יוֹחַי אִם יֹאמַר לָךְ אָדָם שְׁמוֹנָה מַשְׁקִין הֵן אֱמוֹר לֹו הֲרֵי טַל וּמַיִם מִין אֶחָד הֵן וּמָנוּ אוֹתָן חֲכָמִים שְׁנַיִם. אִילּוּ הֲוָה לָון חוֹרָן לֹא מְנוּנֵיהּ וְאִין הֲוָה חוֹרָן לֹא הֲוָה מְנוּנֵיהּ.

Rebbi Joḥanan in the name of Rebbi Simeon ben Ioḥai: If somebody would say to you there are eight drinks, tell him, are not dew and water the same? But they counted them as two! If we had another, would they not have counted it? If another did exist, would they not have counted it?
