Se’if 1א׳

חֲלֵב בְּהֵמָה וְחַיָּה טְמֵאָה אוֹ טְרֵפָה, וְצִירָהּ וּמֵי רַגְלֶיהָ אֲסוּרִים כִּבְשָׂרָהּ. וְיֵשׁ מִי שֶׁמַּתִּיר בְּמֵי רַגְלֶיהָ (רַמְבַּ"ם פ"ד ד"כ). אֲבָל מֵי רַגְלַיִם דְּאָדָם, לְדִבְרֵי הַכֹּל, מֻתָּרִים.

The milk of a domestic animal or a wild animal that is unclean or a tereifah (an animal with a fatal defect), and its brine and its urine, are forbidden as its flesh is. And there is one who permits its urine (Rambam, chapter 4, law 20). But the urine of a man, by the words of all, is permitted.

גְּבִינוֹת שֶׁנַּעֲשׂוּ מֵחֲלֵב בְּהֵמָה וְנִמְצָא טְרֵפָה, אִם הוּא טְרֵפוּת שֶׁאֶפְשָׁר שֶׁלֹּא אֵרַע לָהּ אֶלָּא עַתָּה (ס"א שֶׁאֵרַע לָהּ עַתָּה וְעִקָּר), כְּגוֹן נִקַּב קְרוּם שֶׁל מֹחַ וְכַיּוֹצֵא בּוֹ, מֻתֶּרֶת, דְּאָמְרִינָן הַשְׁתָּא הוּא דְּנִטְרְפָה. אֲבָל אִם יָדוּעַ שֶׁקֹּדֶם שֶׁחֲלָבָהּ נִטְרְפָה, כְּגוֹן יַתֶּרֶת אֵבֶר שֶׁנִּטְרֶפֶת בּוֹ, אוֹ הֻגְלַד פִּי הַמַּכָּה שֶׁבְּיָדוּעַ שֶׁשְּׁלֹשָׁה יָמִים קֹדֶם הַשְּׁחִיטָה הָיָה, כָּל הַגְּבִינוֹת שֶׁנַּעֲשׂוּ מֵחֲלָבָהּ, אֲסוּרוֹת. הַגָּה: מִיהוּ, בְּהֻגְלַד פִּי הַמַּכָּה אֵין לֶאֱסֹר רַק הַנַּעֲשֶׂה מִמֶּנָּהּ תּוֹךְ ג' יָמִים, אֲבָל מַה שֶּׁנַּעֲשָׂה מֵחֲלָבָהּ קֹדֶם לָזֶה, שָׁרֵי (סמ"ק וְהַגָּהוֹת מַיְמוֹנִי וּמהרא"י בְּהַגָּהָת ש"ד וְאו"ה כְּלָל מ"ט וְאָגוּר). אֲבָל בְּיַתֶּרֶת אוֹ שְׁאָר טְרֵפוּת הַבָּא מִן הַבֶּטֶן, מַה שֶּׁנַּעֲשֶׂה מִמֶּנָּהּ מֵעוֹלָם, אָסוּר (או"ה שָׁם). וְאִם הָיְתָה בְּעֵדֶר עִם בְּהֵמוֹת אֲחֵרוֹת, וְנִתְעָרֵב חֲלָבָהּ עִם חֲלֵב הָאֲחֵרוֹת, הוֹלְכִים בּוֹ אַחַר שִׁעוּר שִׁשִּׁים. הַגָּה: וְאִם יֵשׁ ס' בְּהֵמוֹת בָּעֵדֶר, וְלֹא יָדְעִינָן בְּוַדַּאי שֶׁחָלָב מִן הַטְּרֵפָה הִיא יוֹתֵר מֵחֲלֵב אַחַת הָאֲחֵרוֹת, אָמְרִינָן מִסְּתָמָא דְּאִכָּא שִׁשִּׁים, וּמֻתָּר (סְבָרַת עַצְמוֹ). וְדַוְקָא כְּשֶׁנִּתְעָרֵב הֶחָלָב, אֲבָל אִם נִתְעָרְבוּ הַגְּבִינוֹת אֵינָן בְּטֵלוֹת, דְּהָוֵי חֲתִיכָה הָרְאוּיָה לְהִתְכַּבֵּד וַאֲפִלּוּ בְּאֶלֶף לֹא בָּטִיל. (תה"ד וּבְאָרֹךְ כְּלָל מ"ט וּתְשׁוּבַת רַשְׁבָּ"א סי' תקי"ח). וְאִם נִטְרְפָה עַל יְדֵי סִרְכָא, אֵין אוֹסְרִין הַגְּבִינוֹת שֶׁנַּעֲשׂוּ מֵחֲלָבָהּ, מִשּׁוּם דְּהָוֵי סְפֵק סְפֵיקָא. הַגָּה: וְיֵשׁ אוֹסְרִין אֲפִלּוּ בְּסִרְכָא, מַה שֶּׁנֶּחֱלַב תּוֹךְ שְׁלֹשָׁה יָמִים (רַשְׁבָּ"א וְר"ן), וְכֵן יֵשׁ לִנְהֹג אִם אֵין הֶפְסֵד מְרֻבֶּה.

Cheeses that were made from the milk of an animal that was found to be a tereifah: if it is a defect of a tereifah such that it is possible that it befell her only now (another reading: that it befell her now, and that is the principal one), such as where the membrane of the brain was perforated and the like, they are permitted, for we say: it is now that she became a tereifah. But if it is known that she became a tereifah before she was milked — such as an extra limb by which she is made a tereifah, or where the mouth of the wound had scabbed over, in which case it is known that it was three days before the slaughter — all the cheeses that were made from her milk are forbidden. Hagah [Rema]: However, where the mouth of the wound had scabbed over, only what was made from her within three days is to be forbidden; but what was made from her milk before that is permitted (Semak and Hagahot Maimoni and Maharai in the Hagahat Shaarei Dura and Issur v'Heter haAroch, klal 49, and Agur). But in the case of an extra limb, or the other defects of a tereifah that come from the belly, whatever was ever made from her is forbidden (Issur v'Heter haAroch there). And if she was in a herd with other animals, and her milk became mixed with the milk of the others, they go in the matter after the measure of sixty. Hagah [Rema]: And if there are sixty animals in the herd, and we do not know for certain that the milk from the tereifah is more than the milk of any one of the others, we say that presumably there is sixty, and it is permitted (his own reasoning). And this is specifically where the milk became mixed; but if the cheeses became mixed they are not nullified, for it is a piece fit to be served to guests, and even in a thousand it is not nullified. (Terumat haDeshen, and in the Issur v'Heter haAroch, klal 49, and a responsum of the Rashba, siman 518.) And if she became a tereifah by reason of a sircha (an adhesion on the lung), they do not forbid the cheeses that were made from her milk, because it is a double doubt. Hagah [Rema]: And there are those who forbid, even in the case of a sircha, what was milked within three days (Rashba and Ran); and so one is to practise if there is no great loss.

יָאלֵי דְּיַחְמוּרְתָא (פי', כְּעֵין בֵּיצֵי זָכָר שֶׁיַּחְמוּרֶת מַשְׁלֶכֶת מֵרַחְמָהּ), מֻתָּרִים.
