Se’if 1א׳
אָסוּר לְהַטִּיל מוּם בִּבְכוֹר; אֲפִלּוּ לִגְרֹם לוֹ מוּם, כְּגוֹן לִתֵּן דְּבֵלָה עַל גַּבֵּי אָזְנוֹ כְּדֵי שֶׁיִּטְּלֶנָּה הַכֶּלֶב מִשָּׁם וְיִקְטַע אָזְנוֹ עִמָּהּ וְכַיּוֹצֵא בָּזֶה, אוֹ שֶׁאוֹמֵר לְעוֹבֵד כּוֹכָבִים לְהַטִּיל בּוֹ מוּם. וְאִם עָשָׂה מוּם בְּיָדַיִם אוֹ בִּגְרָמָתוֹ, אֵין שׁוֹחֲטִין אוֹתוֹ עַל יָדוֹ עַד שֶׁיִּפֹּל בּוֹ מוּם אַחֵר מֵעַצְמוֹ. וְאִם מֵת, אֵין קוֹנְסִין בְּנוֹ אַחֲרָיו, אֶלָּא שׁוֹחֲטִין אוֹתוֹ עַל יָדוֹ.
It is forbidden to put a blemish in a firstborn; even to cause a blemish in it, such as to put a cake of pressed figs on its ear so that a dog should take it from there and tear off its ear with it, and the like; or to tell an idolater to put a blemish in it. And if he made a blemish with his hands or by his causing, one does not slaughter it on account of it until another blemish falls in it of itself. And if he died, one does not penalise his son after him; rather, one slaughters it on account of it.
Se’if 2ב׳
אִם עוֹבֵד כּוֹכָבִים אוֹ תִּינוֹק מַטִּיל בּוֹ מוּם מֵעַצְמוֹ, אִם לֹא כִּוֵּן לְהַתִּירוֹ, מֻתָּר, אֲפִלּוּ אִם שָׁאַל: לָמָּה אֵין שׁוֹחֲטִין אוֹתוֹ, וְהֵשִׁיבוּ לוֹ לְפִי תֻּמָּם שֶׁאָסוּר לְשָׁחֲטוֹ עַד שֶׁיִּפֹּל בּוֹ מוּם. אֲבָל אִם כִּוֵּן לְהַתִּירוֹ, כְּגוֹן לְאַחַר שֶׁרוֹאֶה שֶׁהִתִּירוּהוּ עַל יְדֵי כָּךְ עוֹשֶׂה כֵּן לַאֲחֵרִים, אָסוּר. סָפֵק אִם כִּוֵּן לְהַתִּירוֹ אוֹ לֹא, אַזְלִינָן לְקֻלָּא (הַגָּהוֹת מָרְדְּכַי דְּחֻלִּין). וְאִם עוֹבֵד כּוֹכָבִים מֵסִיחַ לְפִי תֻּמּוֹ וְאוֹמֵר שֶׁהַיִּשְׂרָאֵל צִוָּהוּ, אָסוּר (ת"ה סי' קס"ט).
If an idolater or a child puts a blemish in it of his own accord: if he did not intend to permit it, it is permitted — even if he asked: why do you not slaughter it? and they answered him in their innocence that it is forbidden to slaughter it until a blemish falls in it. But if he intended to permit it, such as where, after he sees that they permitted it by this means, he does so to others, it is forbidden. If it is doubtful whether he intended to permit it or not, we go to the lenient side (Hagahot Mordechai on Chullin). And if an idolater speaks in his innocence (mesiach lefi tumo — one who tells of a thing in passing, with no thought of giving testimony) and says that the Israelite commanded him, it is forbidden (Terumat haDeshen, siman 169).

אִם אָמְרוּ לְעוֹבֶדֶת כּוֹכָבִים הַמְשָׁרֶתֶת בְּבֵית יְהוּדִי, עַל הַבְּכוֹר, שֶׁאֵין לְאָכְלוֹ בְּלֹא מוּם, וְהָלְכָה וְחָתְכָה אָזְנוֹ, חָשׁוּב לָדַעַת וְאֵין שׁוֹחֲטִין אוֹתוֹ עָלָיו, מִפְּנֵי שֶׁעוֹבֶדֶת כּוֹכָבִים זוֹ כִּוְּנָה לְהַתִּירוֹ, וְגַם הָאוֹמְרִים לָהּ שֶׁאֵינוֹ נֶאֱכָל בְּלֹא מוּם כִּוְּנוּ לְכָךְ שֶׁתַּטִּיל בּוֹ מוּם. הַגָּה: מֻתָּר לִתֵּן בְּכוֹר לְעוֹבֵד כּוֹכָבִים כְּדֵי לְגַדְּלוֹ, וְאִם הִטִּיל הַשּׁוֹמֵר בּוֹ מוּם, מֻתָּר, וְלֹא אַמְרִינָן דְּכִוֵּן לְהַתִּירוֹ, אַף עַל פִּי שֶׁיּוֹדֵעַ שֶׁנִּתָּר בְּמוּמוֹ וְשֶׁהוּא בְּכוֹר (פִּסְקֵי מהרא"י סי' קס"ח).
If they said to an idolatress serving in the house of a Jew, concerning the firstborn, that it may not be eaten without a blemish, and she went and cut its ear, it is reckoned as done knowingly, and one does not slaughter it on account of it; for this idolatress intended to permit it, and those who said to her that it is not eaten without a blemish also intended that she should put a blemish in it. Hagah [Rema]: It is permitted to give a firstborn to an idolater to rear it, and if the keeper put a blemish in it, it is permitted, and we do not say that he intended to permit it, even though he knows that it is permitted through its blemish and that it is a firstborn (Piskei Maharai, siman 168).
