אִם לֹא מָל הָאָב אֶת בְּנוֹ, חַיָּבִים בֵּית דִּין לְמוּלוֹ. וְאִם לֹא מָלוּהוּ בֵּית דִּין, חַיָּב הוּא, כְּשֶׁיַּגְדִּיל, לָמוּל אֶת עַצְמוֹ. וְאִם לֹא מָל, חַיָּב כָּרֵת. הַגָּה: וּבְכָל יוֹם עוֹבְרִים בָּעֳנָשִׁין אֵלּוּ. (טוּר וּבְכָל בּוֹ) וְאֵין מָלִין בְּנוֹ שֶׁל אָדָם שֶׁלֹּא מִדַּעְתּוֹ, אֶלָּא אִם כֵּן עָבַר הָאָב, וְלֹא מָלוּ בֵּית דִּין, מָלִין אוֹתוֹ בְּעַל כָּרְחוֹ. (טוּר בְּשֵׁם הָרַמְבַּ"ם). וְאֵין הָאִשָּׁה חַיֶּבֶת לָמוּל אֶת בְּנָהּ. (טוּר). הָאָב שֶׁאֵינוֹ יוֹדֵעַ לָמוּל, וְיֵשׁ כָּאן מוֹהֵל שֶׁאֵינוֹ רוֹצֶה לָמוּל בְּחִנָּם, רַק בְּשָׂכָר, יֵשׁ לְבֵית דִּין לִגְעֹר בְּמוֹהֵל זֶה, כִּי אֵין זֶה דַּרְכָּן שֶׁל זֶרַע אַבְרָהָם, וְאַדְּרַבָּה הַמוֹהֲלִים מְהַדְּרִין שֶׁיִּתְּנוּ לָהֶם לָמוּל. וְאִם עוֹמֵד בְּמִרְדּוֹ, וְאֵין יַד הָאִישׁ מַשֶּׂגֶת לָתֵת לוֹ שְׂכָרוֹ, הָוֵי כְּמִי שֶׁאֵין לוֹ אָב שֶׁבֵּית דִּין חַיָּבִים לְמוּלוֹ, וְלָכֵן בֵּית דִּין כּוֹפִין אוֹתוֹ, מֵאַחַר שֶׁאֵין אַחֵר שֶׁיָּמוּל (רַשְׁבָּ"א סי' תע"ב).
If the father did not circumcise his son, the court is obliged to circumcise him. And if the court did not circumcise him, he is obliged, when he grows up, to circumcise himself. And if he did not circumcise, he is liable to karet (excision at the hand of Heaven). Hagah [Rema]: And every day they stand in transgression of these punishments (Tur and Kol Bo). And one does not circumcise a man's son without his consent; but if the father transgressed and the court did not circumcise, they circumcise him against his will (Tur in the name of the Rambam). And the woman is not obliged to circumcise her son (Tur). A father who does not know how to circumcise, and there is a circumciser here who does not want to circumcise for nothing, only for a fee — the court should rebuke this circumciser, for this is not the way of the seed of Abraham; on the contrary, the circumcisers are eager that they be given children to circumcise. And if he persists in his defiance, and the man's means do not reach to give him his fee, it is as one who has no father, whom the court is obliged to circumcise; and therefore the court compels him, since there is no other who will circumcise (the Rashba, siman 472).
