הָאוֹמֵר: סֶלַע זוֹ לִצְדָקָה, אוֹ שֶׁאוֹמֵר: הֲרֵי עָלַי סֶלַע לִצְדָקָה, וְהִפְרִישׁוֹ, עַד שֶׁלֹּא בָּא לְיַד הַגַּבַּאי יָכוֹל לְשַׁנּוֹתוֹ, בֵּין לִלְווֹתוֹ לְעַצְמוֹ בֵּין לְהַלְווֹתוֹ לַחֲבֵרוֹ, וְיִפְרַע אַחֵר תַּחְתָּיו. הַגָּה: וְכֵן אִם הִקְדִּישׁ כֵּלִים, יָכוֹל לְמָכְרָם לִפְנֵי ג' בְּקִיאִים בְּשׁוּמָא, וְנוֹתֵן דְּמֵיהֶם לִצְדָקָה. (בֵּית יוֹסֵף בְּשֵׁם הַגָּהוֹת מָרְדְּכַי דִּכְתֻבּוֹת). מִשֶּׁבָּא לְיַד גַּבַּאי, אָסוּר לִלְווֹתוֹ, בֵּין לוֹ בֵּין לְאַחֵר בֵּין לַגַּבַּאי. וְאִם הָיָה הֲנָאָה לַעֲנִיִּים בְּעִכּוּב הַמָּעוֹת בְּיַד הַגַּבַּאי, כְּדֵי לְעַשׂוֹת לַאֲחֵרִים לִתֵּן, הֲרֵי הַגַּבַּאי מֻתָּר לִלְווֹתָם וּלְפָרְעָם. הַגָּה: דְּאֵין הַצְּדָקָה כְּהֶקְדֵּשׁ, וּמֻתָּר לֵהָנוֹת מִמֶּנָּהּ. (טוּר). וְאֵין נוֹשְׂאִין וְנוֹתְנִין בִּצְדָקָה הָעוֹמֶדֶת לְחַלֵּק לַעֲנִיִּים, כִּי אִם כֶּסֶף בְּכֶסֶף וְכַיּוֹצֵא בוֹ, שֶׁמָּא יָבֹאוּ עֲנִיִּים וְלא יִהְיֶה לָהֶם מָעוֹת לְחַלֵּק. אֲבָל צְדָקָה שֶׁאֵינָהּ עוֹמֶדֶת לְחַלֵּק, רַק הַקֶּרֶן יְהֵא קַיָּם וְיֹאכְלוּ הַפֵּרוֹת, שָׁרֵי. (בֵּית יוֹסֵף בְּשֵׁם סה"ת שַׁעַר מ"ו ח"ד ס"ח וְהַגָּהוֹת מַיְמוֹנִי). וְכֵן נוֹהֲגִין.

One who says: this sela is for charity, or who says: a sela is upon me for charity, and set it apart — until it has come into the hand of the collector he may change it, whether to borrow it for himself or to lend it to his fellow, and repay another in its place. Hagah [Rema]: And likewise, if he consecrated vessels, he may sell them before three people expert in valuation and give their value to charity (Beit Yosef in the name of Hagahot Mordechai on Ketubot). Once it has come into the hand of the collector, it is forbidden to borrow it, whether for himself, or for another, or for the collector. And if there was a benefit to the poor in the money's being held back in the collector's hand, so as to prompt others to give, the collector is permitted to borrow it and repay it. Hagah [Rema]: For charity is not like hekdesh (property dedicated to sacred use), and it is permitted to benefit from it (Tur). And one does not trade with charity that stands to be distributed to the poor, except silver for silver and the like, lest poor people come and they have no money to distribute. But charity that does not stand to be distributed, where only the principal shall remain and they will consume the yield, is permitted (Beit Yosef in the name of Sefer haTerumot, gate 46, part 4, siman 8, and Hagahot Maimoni). And so is the practice.

צְדָקוֹת שֶׁהִתְנַדְּבוּ לְצֹרֶךְ בֵּית הַכְּנֶסֶת אוֹ לְצֹרֶךְ בֵּית עָלְמִין, יְכוֹלִים בְּנֵי הָעִיר לְשַׁנּוֹתָם לְצֹרֶךְ בֵּית הַמִּדְרָשׁ אוֹ תַּלְמוּד תּוֹרָה, אֲפִלּוּ אִם הַבְּעָלִים מְעַכְּבִים, אֲבָל לֹא מִתַּלְמוּד תּוֹרָה לְצֹרֶךְ בֵּית הַכְּנֶסֶת. הַגָּה: וְדַוְקָא בִּדְאִכָּא לְמֵיחַשׁ שֶׁלֹּא יִהְיֶה לָהֶם סִפּוּק לְתַלְמוּד תּוֹרָה, אֲבָל בְּמָקוֹם שֶׁבְּנֵי הָעִיר מְסַפְּקִים לְתַלְמוּד תּוֹרָה, וְאִם יוֹצִיאוּ אֵלּוּ הַמָּעוֹת לְצֹרֶךְ בֵּית הַכְּנֶסֶת יִתְּנוּ מָעוֹת אֲחֵרִים לְתַלְמוּד תּוֹרָה כְּשֶׁיִּצְטָרְכוּ, מֻתָּר. (מהרי"ק שֹׁרֶשׁ קכ"ח). וַאֲפִלּוּ אִם הוּא בְּמָקוֹם שֶׁאָסוּר לְשַׁנּוֹת, אִם אֵינָן צְרִיכִים לַדָּבָר שֶׁנָּדַר, כְּגוֹן שֶׁהִקְדִּישׁ קַרְקַע לִבְנוֹת עָלֶיהָ בֵּית הַמִּדְרָשׁ, וְאֵינָן יְכוֹלִין לִבְנוֹת מִיָּד, אֵין הַמִּתְנַדֵּב יָכוֹל לַחֲזֹר בּוֹ אֶלָּא יִהְיֶה עוֹמֵד כָּךְ עַד שֶׁיִּבְנוּ עָלֶיהָ. (מָרְדְּכַי פ' בְּנֵי הָעִיר). וְכָל זֶה בְּמָקוֹם שֶׁאֵין מִנְהָג יָדוּעַ בָּעִיר, אֲבָל בְּמָקוֹם שֶׁנּוֹהֲגִים שֶׁהַגַּבַּאי אוֹ בְּנֵי הָעִיר מְשַׁנִּים לְכָל מַה שֶּׁיִּרְצוּ, אוֹ אֲפִלּוּ בְּמָקוֹם שֶׁנּוֹהֲגִים שֶׁאָדָם מֵשִׂים אֵיזֶה דָּבָר בְּבֵית הַכְּנֶסֶת, כְּגוֹן סֵפֶר תּוֹרָה אוֹ כְּלֵי כֶּסֶף וְכַדּוֹמֶה, וּכְשֶׁיִּרְצֶה חוֹזֵר וְלוֹקְחוֹ, וּכְשֶׁיּוֹרֵד מִנְּכָסָיו מוֹכְרוֹ לַאֲחֵרִים, הוֹלְכִים אַחַר הַמִּנְהָג. דְּכָל מַקְדִּישׁ אַדַּעְתָּא דְּמִנְהָג הוּא מַקְדִּישׁ, וְלֵב בֵּית דִּין מַתְנֶה עַל זֶה, וּבִלְבַד שֶׁיִּהְיֶה מִנְהָג קָבוּעַ. (כֵּן מַשְׁמָע מֵהַבֵּית יוֹסֵף וממהרי"ק שֹׁרֶשׁ קס"א). וּמִכָּל מָקוֹם אִם הִתְנָה הַמַּקְדִּישׁ בְּפֵרוּשׁ שֶׁלֹּא יְשַׁנּוּ הֶקְדְּשׁוֹ וְלֹא יְהֵא כֹּחַ בָּזֶה, פְּשִׁיטָא שֶׁאָסוּר לְשַׁנּוֹתוֹ. וְעַיֵּן לְעֵיל סי' רנ"ו סָעִיף ד'.

Charities that were donated for the needs of the synagogue or for the needs of a cemetery — the people of the city may change them to the needs of the house of study or of Talmud Torah (the support of Torah study), even if the owners object; but not from Talmud Torah to the needs of the synagogue. Hagah [Rema]: And specifically where there is concern that they will not have enough for Talmud Torah; but in a place where the people of the city provide for Talmud Torah, and if they spend this money for the needs of the synagogue they will give other money for Talmud Torah when they need it, it is permitted (Maharik, shoresh 128). And even if it is in a place where it is forbidden to change, if they do not need the thing for which he vowed — such as where he consecrated land to build a house of study upon it, and they cannot build at once — the donor cannot retract it; rather it shall stand so until they build upon it (Mordechai, chapter "The people of the city"). And all this is in a place where there is no known custom in the city; but in a place where they are accustomed that the collector or the people of the city change it for whatever they wish, or even in a place where they are accustomed that a man places some thing in the synagogue, such as a Torah scroll or vessels of silver and the like, and when he wishes he takes it back, and when he comes down from his wealth he sells it to others — they follow the custom. For everyone who consecrates, consecrates with the custom in mind, and the mind of the court makes a stipulation concerning this; provided that it is a fixed custom (so it is implied by the Beit Yosef and by Maharik, shoresh 161). And nevertheless, if the one who consecrates stipulated expressly that they shall not change his consecration and that there shall be no power to do so, it is obvious that it is forbidden to change it. יִשְׂרָאֵל שֶׁהִתְנַדֵּב נֵר אוֹ מְנוֹרָה לְבֵית הַכְּנֶסֶת, אִם נִשְׁתַּקַּע שֵׁם בְּעָלֶיהָ מֵעָלֶיהָ שֶׁאֵינָהּ נִקְרֵאת עַל שְׁמוֹ, יְכוֹלִים הַצִּבּוּר לְשַׁנּוֹתָהּ אֲפִלּוּ לִדְבַר הָרְשׁוּת, אֲפִלּוּ אִם גַּם הַמִּתְנַדֵּב מוֹחֶה (מהרי"ק שֹׁרֶשׁ קכ"ג קכ"ד וּבְשֵׁם רַשְׁבָּ"א וּתְשׁוּבַת רא"ש). וְאִם לֹא נִשְׁתַּקַּע שָׁם בְּעָלֶיהָ מֵעָלֶיהָ, אֵין יְכוֹלִים לְשַׁנּוֹתוֹ לִדְבַר הָרְשׁוּת, אֲבָל לִדְבַר מִצְוָה יְכוֹלִים לְשַׁנּוֹתוֹ. וְאִם הָיָה הַמִּתְנַדֵּב גּוֹי, אָסוּר לְשַׁנּוֹתָהּ אֲפִלּוּ לִדְבַר מִצְוָה, כָּל זְמַן שֶׁלֹּא נִשְׁתַּקַּע שֵׁם בְּעָלֶיהָ מֵעָלֶיהָ. וְכָל זְמַן שֶׁשֵּׁם בְּעָלִים חָקוּק עַל הַכֵּלִים שֶׁנָּתַן, לֹא נִשְׁתַּקַּע שֵׁם בְּעָלֶיהָ. (יְרוּשַׁלְמִי פ' בְּנֵי הָעִיר).

An Israelite who donated a lamp or a candelabrum to the synagogue — if the name of its owners has been forgotten from it, so that it is not called by his name, the congregation may change it even to a matter of choice, even if the donor too protests (Maharik, shoresh 123 and 124, and in the name of the Rashba, and a responsum of the Rosh). And if the name of its owners has not been forgotten from it, they cannot change it to a matter of choice, but to a matter of mitzvah they may change it. And if the donor was a gentile, it is forbidden to change it even to a matter of mitzvah, so long as the name of its owners has not been forgotten from it. And so long as the owners' name is engraved on the vessels that he gave, the name of its owners has not been forgotten (Yerushalmi, chapter "The people of the city").
