Se’if 1א׳
הַמַּתְפִּיס בִּצְדָקָה הֲרֵי זֶה כְּמַתְפִּיס בְּנֶדֶר. כֵּיצַד, הָיָה סֶלַע שֶׁל צְדָקָה מֻנָּח לְפָנָיו וְאָמַר עַל אַחֵר: הֲרֵי זֶה כְּזֶה, הֲרֵי זֶה צְדָקָה. הַגָּה: אַל יֹאמַר אָדָם: סֶלַע זֶה לְהֶקְדֵּשׁ, אֶלָּא לִצְדָקָה. (מָרְדְּכַי רֵישׁ פ"ק דַּעֲבוֹדַת כּוֹכָבִים וּבֵית יוֹסֵף סוֹף סִימָן רנ"ט בְּשֵׁם הג"א שָׁם וְכָל בּוֹ). וּמִכָּל מָקוֹם אִם אָמַר: לְהֶקְדֵּשׁ, סְתָם, כַּוָנָתוֹ לִצְדָקָה לַעֲנִיִּים. (בֵּית יוֹסֵף בְּשֵׁם הָרַמְבַּ"ן ותשו' רַשְׁבָּ"א סי' תשמ"ב). וּמִיהוּ אִם אָמַר שֶׁכַּוָנָתוֹ לְהֶקְדֵּשׁ מַמָּשׁ, אֵין לוֹ תַּקָּנָה לֵהָנוֹת מִמֶּנּוּ, וְצָרִיךְ לִשְׁאֹל לְחָכָם, וּמַתִּירִין לוֹ בַּחֲרָטָה כִּשְׁאָר נֶדֶר. (הַגָּהוֹת אֲשֵׁרִי שָׁם).
One who attaches a thing to charity — this is as one who attaches it to a vow. How so? A sela of charity was lying before him, and he said of another: this is like this — this is charity. Hagah [Rema]: A man should not say: this sela is for hekdesh (property dedicated to sacred use), but: for charity (Mordechai, the beginning of chapter 1 of Avodah Zarah, and Beit Yosef, end of siman 259, in the name of Hagahot Asheri there, and Kol Bo). And nevertheless, if he said: for hekdesh, without specifying, his intention is charity for the poor (Beit Yosef in the name of the Ramban, and a responsum of the Rashba, siman 742). However, if he said that his intention was for hekdesh proper, he has no remedy by which to benefit from it, and he must ask a sage, and they release him through regret, as with any other vow (Hagahot Asheri, there).
Se’if 2ב׳
הַמַּפְרִישׁ סֶלַע וְאָמַר: הֲרֵי זֶה צְדָקָה. וְאָמַר עַל אַחֵר: וְזֶה, גַּם הַשֵּׁנִי צְדָקָה. וְאִם רָצָה לוֹמַר עַל סֶלַע זֶה, וְהוֹצִיא בִּשְׂפָתָיו עַל אַחֵר, הָוֵי טָעוּת וְאֵינוֹ כְּלוּם. (שָׁם בְּהַגָּהוֹת אֲשֵׁרִי).
One who set apart a sela and said: this is charity, and said of another: and this — the second too is charity. And if he meant to speak of this sela, and brought out with his lips concerning another, it is an error and it is nothing (there, in Hagahot Asheri).
Se’if 3ג׳
הַנּוֹדֵר צְדָקָה וְאֵינוֹ יוֹדֵעַ כַּמָּה נָדַר, מַרְבֶּה לִתֵּן עַד שֶׁיֹּאמַר: לֹא לְכָל כָּךְ נִתְכַּוַּנְתִּי.
One who vows charity and does not know how much he vowed gives more and more until he says: I did not intend so much.
