הַמֻּדָּר מֵחֲתָנוֹ וְהוּא רוֹצֶה לָתֵת לְבִתּוֹ מָעוֹת, כְּדֵי שֶׁתְּהֵא נֶהֱנֵית בָּהֶם וּמוֹצִיאָה אוֹתָם בַּחֲפָצֶיהָ, הֲרֵי זֶה נוֹתֵן לָהּ וְאוֹמֵר לָהּ: הָרֵי הַמָּעוֹת הַלָּלוּ נְתוּנִים לָךְ בְּמַתָּנָה, וּבִלְבַד שֶׁלֹּא יְהֵא לְבַעֲלֵךְ רְשׁוּת בָּהֶן, אֶלָּא יִהְיוּ לְמַה שֶּׁאַתְּ נוֹתֶנֶת לְתוֹךְ פִּיךְ אוֹ לְמַה שֶּׁתִּלְבְּשִׁי, וְכַיּוֹצֵא בָזֶה. וַאֲפִלּוּ אָמַר: עַל מְנַת שֶׁאֵין לְבַעֲלֵךְ רְשׁוּת בָּהֶם אֶלָּא מַה שֶּׁתִּרְצִי עֲשִׂי בָּהֶם, לֹא קָנָה הַבַּעַל, וּמַה שֶּׁתִּרְצֶה תַּעֲשֶׂה בָּהֶם. אֲבָל אִם נָתַן לָהּ מַתָּנָה וְאָמַר לָהּ: עַל מְנַת שֶׁאֵין לְבַעֲלֵךְ רְשׁוּת בָּהֶם, וְלֹא פֵּרֵשׁ שֶׁתְּהֵא הַמַּתָּנָה הַזֹּאת לְכָךְ וּלְכָךְ אוֹ לְמַה שֶּׁתִּרְצֶה תַּעֲשֶׂה בָּהֶם, הֲרֵי זֶה יִקְנֶה אוֹתָהּ הַבַּעַל לֶאֱכֹל פֵּירוֹתֶיהָ, וְדָבָר זֶה אָסוּר, שֶׁהֲרֵי הוּא אָסוּר בַּהֲנִיַּת חוֹתְנוֹ. וְיֵשׁ אוֹמְרִים דַּאֲפִילוּ בְּאוֹמֵר לָהּ: עַל מְנַת שֶׁאֵין לְבַעֲלֵךְ רְשׁוּת בָּהֶם, וּמַה שֶּׁתִּרְצִי תַּעֲשִׂי בָּהֶם, קָנָה הַבַּעַל וְאָסוּר בָּהֶם.

One whose son-in-law is under a vow from him, and he wishes to give his daughter money so that she may have benefit from it and spend it on the things she wants — he gives to her and says to her: behold, this money is given to you as a gift, provided that your husband have no authority over it, but that it be for what you put into your mouth or for what you shall wear, and the like of this. And even if he said: on condition that your husband have no authority over it, but whatever you wish do with it — the husband has not acquired it, and whatever she wishes she does with it. But if he gave her a gift and said to her: on condition that your husband have no authority over it, and did not specify that this gift shall be for such and such, or for whatever she wishes to do with it — the husband will acquire it to eat its fruits, and this thing is forbidden, for he is forbidden in the benefit of his father-in-law. And there are those who say that even where he says to her: on condition that your husband have no authority over it, and whatever you wish you shall do with it — the husband has acquired it and is forbidden in it.
