Se’if 1א׳
הָאוֹמֵר נֶדֶר שֶׁאֲנִי רוֹצֶה לִדֹּר לֹא יְהֵא נֶדֶר, וְנָדַר, אֵינוֹ נֶדֶר. בַּמֶּה דְּבָרִים אֲמוּרִים, שֶׁהוֹצִיא תְּחִלָּה בִּשְׂפָתָיו לוֹמַר שֶׁלֹּא יְהֵא נֶדֶר; אֲבָל אִם חָשַׁב כָּךְ בְּלִבּוֹ, הָוֵי דְּבָרִים שֶׁבַּלֵּב וְאֵינָם מְבַטְּלִים הַנֶּדֶר שֶׁהוֹצִיא בִּשְׂפָתָיו. וְיֵשׁ אוֹמְרִים דַּאֲפִילוּ אָמַר כֵּן בְּלַחַשׁ, הָוֵי דְּבָרִים שֶׁבַּלֵּב. הַגָּה: וְהָא דְּאָמְרִינַן כָּל נִדְרֵי בְּלֵיל יוֹם כִּפּוּרִים הָוֵי כְּאִלּוּ הִתְנוּ בְּהֶדְיָא וּמִכָּל מָקוֹם לֹא סָמְכִינַן עַל זֶה לְהַתִּיר בְּלֹא שְׁאֵלָה לְחָכָם, כִּי אִם לְצֹרֶךְ גָּדוֹל (מהרי"ו סִימָן ב').
One who states: "The vows I wish to vow shall not be vows", and then vows - this is no vow. This is only the case when one expresses the condition verbally, but if one merely thought of this, it is a matter of the heart, and cannot cancel the vow that was spoken. There are those who say that even if one whispers such a condition, it is like a mater of the heart. RAMA: As for us, when we say Kol Nidrei on the eve of Yom Kippur, it is as if we are making this condition. Nonetheless, we do not rely on this to permit things without asking the rabbis, except for urgent cases.
Se’if 2ב׳
מִי שֶׁהִתְנָה וְאָמַר: כָּל נְדָרַי שֶׁאֶדֹּר עַד זְמַן פְּלוֹנִי יִהְיוּ בְּטֵלִים, וְנָדַר בְּתוֹךְ הַזְּמַן, אִם הוּא זוֹכֵר לִתְנָאוֹ בִּשְׁעַת הַנֶּדֶר, נִדְרוֹ קַיָּם שֶׁהֲרֵי מְבַטֵּל תְּנָאוֹ בְּשָׁעָה שֶׁנּוֹדֵר; וְאִם אֵינוֹ זוֹכֵר לִתְנָאוֹ בִּשְׁעַת הַנֶּדֶר, הַתְּנַאי קַיָּם וְהַנֶּדֶר בָּטֵל. וְיֵשׁ אוֹמְרִים שֶׁאֵין הַתְּנַאי מוֹעִיל לְבַטֵּל הַנֶּדֶר, אֶלָּא אִם כֵּן יִזְכְּרֶנוּ תּוֹךְ כְּדֵי דִּבּוּר לַנֶּדֶר וְיֹאמַר בְּלִבּוֹ שֶׁהוּא סוֹמֵךְ עַל הַתְּנַאי, וְיֵשׁ לָחוּשׁ לְדִבְרֵיהֶם.
One who makes the condition: "All vows that I vow until the following time shall be void," and then vows within this time - if they remember the condition at the time of making the vow, then the vow is valid, since the condition is annulled by the vow. If they did not remember the condition at the time of the vow, the condition remains valid and the vow is annulled. There are those who say that the condition cannot annul the vow unless one mentions quickly (toch k'dei dibbur) after the vow that it is being done according to the condition - and one should heed to this opinion.
Se’if 3ג׳
הִתְנָה עַל קְצָת דְּבָרִים שֶׁיְּהֵא נִדְרוֹ בָּטֵל בָּהֶם וְאֵינוֹ יוֹדֵעַ עַל מַה הִתְנָה, אִם עַל אֲכִילַת בָּשָׂר אוֹ שְׁתִיַּת יַיִן; אִם אוֹמֵר בִּשְׁעַת הַנֶּדֶר: עַל דַּעַת רִאשׁוֹנָה אֲנִי נוֹדֵר שֶׁאִם אֶזְכֹּר עַל מַה שֶּׁהִתְנֵיתִי שֶׁאֵלֵךְ אַחַר הַתְּנַאי, וְנִזְכָּר עַל מַה הִתְנָה, הַתְּנַאי קַיָּם וְהַנֶּדֶר בָּטֵל; וְאִם לֹא אָמַר: עַל דַּעַת רִאשׁוֹנָה אֲנִי נוֹדֵר, הַתְּנַאי בָּטֵל וְהַנֶּדֶר קַיָּם.
He made a condition as to some things, that his vow should be void in them, and he does not know as to what he made the condition — whether as to the eating of meat or the drinking of wine: if he says at the hour of the vow: I vow upon the first intention, that if I remember as to what I made the condition I shall go after the condition — and he remembered as to what he made the condition, the condition stands and the vow is void; and if he did not say: I vow upon the first intention, the condition is void and the vow stands.
