אֵין צוֹלִין בְּשַׂר כְּשֵׁרָה עִם בְּשַׂר נְבֵלָה אוֹ שֶׁל בְּהֵמָה טְמֵאָה בְּתַנּוּר אֶחָד, וְאַף עַל פִּי שֶׁאֵין נוֹגְעִים זֶה בָּזֶה. וְאִם צְלָאָן, הֲרֵי זֶה מֻתָּר. וַאֲפִלּוּ הָיְתָה הָאֲסוּרָה שְׁמֵנָה הַרְבֵּה, וְהַמֻתֶּרֶת רָזָה. וְאִם הַתַּנּוּר גָּדוֹל שֶׁמַּחֲזִיק י"ב עֶשְׂרוֹנִים, וּפִיו פָּתוּחַ, מֻתָּר לִצְלוֹתָם בּוֹ, וּבִלְּבַד שֶׁלֹּא יִגְּעוּ זֶה בָּזֶה. וְאִם אֶחָד מֵהֶם מְכֻסֶה בִּקְעָרָה אוֹ בְּבָצֵק וְכַיּוֹצֵא בוֹ, מֻתָּר לִצְלוֹתָם, אֲפִלּוּ בְּתַנּוּר קָטָן וּפִיו סָתוּם. הַגָּה: וְהוּא הַדִּין לְבָשָׂר עִם חָלָב נָמֵי דִּינָא הָכֵי. (טוּר סִימָן צ"ז). וְנוֹהֲגִין לְהַחְמִיר לְכַתְּחִלָּה, אֲפִלּוּ בְּתַנּוּר גָּדוֹל; וּבְדִיעֲבַד, לְהָקֵל אֲפִלּוּ בְּתַנּוּר קָטָן. (אָרֹךְ כְּלָל ל"ט וּבִתְשׁוּבַת ר"י מִינְץ וּבְהַגָּהַת ש"ד וְאָגוּר בְּשֵׁם מַהֲרִי"ל וְטוּר בְּשֵׁם רַשְׁבָּ"א שֶׁכֵּן הַסְכָּמַת רֹב הַמּוֹרִים וְהוּא שִׁיטַת רַשִׁ"י וְה"ג וְרִי"ף וְרַמְבַּ"ם). וְאִם אָפָה פַּת עִם בָּשָׂר, אָסוּר לְאָכְלוֹ עִם חָלָב, אִם יֵשׁ לוֹ פַּת אַחֵר (שָׁם). וְכֵן אִם עוֹבֵד כּוֹכָבִים אָפָה פַּת עִם אִסּוּר, אָסוּר לִקְנוֹת אוֹתוֹ פַּת אִם יֵשׁ פַּת אַחֵר, דְּכָל זֶה מִקְרֵי לְכַתְּחִלָּה. אֲבָל אִם אֵין לוֹ פַּת אַחַר בְּרֶוַח, מֻתָּר בִּשְׁנֵיהֶם, דְּזֶה מִקְרֵי לְעִנְיָן זֶה דִּיעֲבַד. (אָגוּר בְּשֵׁם ר"י מוּלִין). יֵשׁ אוֹמְרִים דְּאֵין מַתִּירִין רֵיחָא, אֲפִלּוּ בְּדִיעֲבַד, אֶלָּא אִם כֵּן הַתַּנּוּר פָּתוּחַ קְצָת מִן הַצַּד אוֹ לְמַעְלָה בְּמָקוֹם שֶׁהֶעָשָׁן יוֹצֵא (שָׁם בְּאָרֹךְ). וּבִמְקוֹם הֶפְסֵד אֵין לְהַחְמִיר, בְּדִיעֲבַד (כִּי כֵן נִרְאֶה מֵהַפּוֹסְקִים וְכ"פ בֵּית יוֹסֵף), אֲפִלּוּ סָתוּם לְגַמְרֵי. וְאִם הָאִסּוּר דָּבָר חָרִיף, וְכָל שֶׁכֵּן אִם הַהֶתֵּר דָּבָר חָרִיף, רֵיחָא מִלְּתָא הִיא וַאֲפִלּוּ בְּדִיעֲבַד אָסוּר, אִם שְׁנֵיהֶם מְגֻלִּים. אֲבָל אִם אֶחָד מֵהֶם מְכֻסֶּה, אֲפִלּוּ בְּבָצֵק בְּעָלְמָא, מֻתָּר. (מָרְדְּכַי פ' ג"ה וְאו"ה). אִם אָפוּ אוֹ צָלוּ אִסּוּר וְהֶתֵּר תַּחַת מַחֲבַת אַחַת מְגֻלִּין, אָסוּר (תּוֹסָפוֹת) אֲפִלּוּ בְּדִיעֲבַד (שָׁם בְּאָרֹךְ). וְהוּא הַדִּין אִם אָפוּ בִּכְהַאי גַּוְנָא פַּת עִם בָּשָׂר, אָסוּר לְאָכְלוֹ בְּחָלָב (ש"ד סִימָן ס' וּמהרא"י). אֲבָל בָּזֶה אַחַר זֶה אֵין לָחוּשׁ (תְּשׁוּבַת מיי' סוֹף הִלְכוֹת מ"א וּתְשׁוּבַת ר"י וְאו"ה), אֶלָּא אִם כֵּן הִזִּיעַ הַמַּחֲבַת מִשְּׁנֵיהֶם, דְּאָז אָסוּר אֲפִלּוּ בָּזֶה אַחַר זֶה, אִם הָיוּ שְׁנֵיהֶם מְגֻלִּין, דְּהָוֵי כְּכִסּוּי שֶׁל קְדֵרָה. (ד"ע מִמַּשְׁמָעוּת הָרֹא"שׁ סִימָן צ"ג), כְּדִלְעֵיל סִימָן צ"ג. יֵשׁ אוֹמְרִים דְּכָל מָקוֹם דְּאָמְרִינַן רֵיחָא מִלְּתָא וְאוֹסֵר בְּדִיעֲבַד, הַיְנוּ דַּוְקָא דְּלֵיכָּא שִׁשִּׁים מִן הַהֶתֵּר נֶגֶד הָאִסּוּר. אֲבָל בִּדְאִכָּא שִׁשִּׁים מִן הַהֶתֵּר, אֲפִלּוּ בְּכָל מַה שֶּׁבַּתַּנּוּר, מְבַטֵּל הָאִסּוּר. (שָׁם בְּאָרֹךְ כְּלָל ל"ט די"ח). וּלְצֹרֶךְ הֶפְסֵד יֵשׁ לִנְהֹג כֵּן. יֵשׁ אוֹמְרִים דְּאִסּוּר הָאוֹסֵר בְּמַשֶּׁהוּ, כְּגוֹן חָמֵץ בְּפֶסַח, רֵיחָא מִלְּתָא וְאוֹסֵר אֲפִלּוּ בְּדִיעֲבַד, אִם הַתַּנּוּר קָטָן וְהוּא סָתוּם, וְהָאִסּוּר וְהַהֶתֵּר מְגֻלִּין תּוֹךְ הַתַּנּוּר. (ד"מ בְּשֵׁם הַגָּהַת סמ"ק וּבְשֵׁם תּוֹסָפוֹת ע"ז דַּף ס"ו ע"ב). וְיֵשׁ אוֹמְרִים שֶׁאֵין לְחַלֵּק. (ד"מ בְּשֵׁם מָרְדְּכַי). וּבִמְקוֹם הֶפְסֵד יֵשׁ לִסְמֹךְ אַדִּבְרֵי הַמְּקִלִּין. וְעַיֵּן לְקַמָּן סוֹף סִימָן קי"ח אִם יֵשׁ לְהַחְמִיר לְכַתְּחִלָּה לִשְׁפּוֹת ב' קְדֵרוֹת, וְא' מֵהֶן שֶׁל אִסּוּר, עַל הַכִּירָה אוֹ לִצְלוֹת אִסּוּר אֵצֶל הֶתֵּר.

Do not roast kosher meat with non-kosher meat or meat of an unclean animal in the same oven, even if they do not touch one another. But if you did roast them, this is permitted - and even if the piece of forbidden meat was very fatty and the piece of permitted meat was lean. But if the oven is large enough to hold 12 esronim, and its mouth is open, then it is permitted to roast them in it as long as they do not touch one another. And if one of them is covered with a bowl or with dough or the like, it is permitted to roast them, even in a small oven with a closed mouth. Comment: The same is true for meat with milk - the ruling is also thus. And it is customary to be strict before the fact, even with a large oven, and after the fact to be lenient even with a small oven. But, if one baked a loaf of bread with meat, it is forbidden to eat it with milk if he has another loaf. And thus if an idolator baked a loaf of bread with something prohibited, it is prohibited to buy that loaf if he has another loaf - because all this is an instance of "before the fact." But if he has no other loaf available, both are permitted, because this is an instance of "after the fact." There are some who say that we do not permit on the basis of smell not being an issue, even after the fact, unless the oven is open from the side or above where the smoke can escape. But in a case of financial loss we are not stringent after the fact, even if the oven is completely closed. If the prohibited thing is pungent, and all the more so if the permitted thing is pungent, smell is an issue and even after the fact it is prohibited, if the two of them are uncovered. But if one of them is covered, even as is common with dough, it is permitted. If they baked or roasted a prohibited thing and a permitted thing under one (covered) frying pan, uncovered (from one another) this is prohibited even after the fact. The same is true if they baked a loaf of bread with meat in such a manner, it is prohibited to eat it with milk. But one after the other there is no concern, unless there was sweat from the pan in both of them, because this is like the cover of a pot. There are some who say that any time we say smell is an issue and prohibit after the fact, that is specifically because there is not 60 times as much of what is permitted as what is prohibited. But if there is 60 times what is permitted, even among everything that is in the oven, the prohibited thing is nullified. And for the sake of loss this is the custom. Three are some who say that a prohibited thing that prohibits something, for example leavening on Passover, smell is an issue and it prohibits even after the fact, if the oven is small and closed, and the prohibited thing and the permitted thing are uncovered within the oven. There are some who say that we do not differentiate. And in a case of loss it is possible to rely on the words of those who are lenient.

Se’if 2ב׳

בַּמֶּה דְּבָרִים אֲמוּרִים, בְּצָלִי. אֲבָל אִם בָּא לְבַשְּׁלָם בִּקְדֵרָה, זֶה לְעַצְמוֹ וְזֶה לְעַצְמוֹ, אֲפִלּוּ בְּתַנּוּר קָטָן וּפִיו סָתוּם, מֻתָּר, וְאַף עַל פִּי שֶׁפִּי הַקְּדֵרוֹת מְגֻלֶּה. הַגָּה: וְדַוְקָא שֶׁהַתַּנּוּר פָּתוּחַ קְצָת, אֲבָל אִם הוּא סָתוּם מִכָּל הַצְּדָדִים כְּדֶרֶךְ שֶׁמַּטְמִינִים הַחַמִּין לְצֹרֶךְ שַׁבָּת, אָסוּר. (מהרי"ו סִימָן מ"ד וְאו"ה וְהַגָּהַת ש"ד בְּשֵׁם מַהֲרָ"ם). וַאֲפִלּוּ בְּדִיעֲבַד יֵשׁ מַחְמִירִין וְאוֹסְרִין, אִם הָאִסּוּר וְהַהֶתֵּר מְגֻלֶּה. (כָּךְ מַשְׁמָע בְּהַגָּהָת ש"ד). וּבִמְקוֹם הֶפְסֵד מְרֻבֶּה יֵשׁ לְהָקֵל.

In what case are these words said? In roasting. And in a case of great loss there is ground to be lenient.

Se’if 3ג׳

אִם יֵשׁ שַׁמְנוּנִית שֶׁל אִסוּר עַל הַמַּרְדֶּה שֶׁקּוֹרִין פאל" א, אָסוּר לִתֵּן עָלֶיהָ הֶתֵּר כָּל הַיּוֹם. מִיהוּ כְּשֶׁאֵינָהּ בַּת יוֹמָא, מֻתָּר לְהִשְׁתַּמֵּשׁ בָּהּ, מִשּׁוּם דְּאִי אֶפְשָׁר בְּעִנְיָן אַחֵר. הַגָּה: כָּל זְמַן שֶׁהִיא בַּת יוֹמָא לֹא מְהָנֵי בָּהּ הַגְעָלָה וְלֹא קְלִיפָה בִּכְלֵי אֻמָּנוּת (ת"ח סִימָן ק"ל וְהַגָּהַת ש"ד וּמָרְדְּכַי).

If there is fat of a forbidden thing upon the baker's peel, which they call pala, it is forbidden to place permitted food upon it the whole day. However, when it is not of that same day it is permitted to use it, since it is impossible in any other way. Hagah [Rema]: So long as it is of that same day, neither purging nor paring is of avail for it, in an implement of a craft (Torat Chatat, siman 130, and the Hagahat Shaarei Dura, and Mordechai).
