אִשְׁתּוֹ שֶׁל אָדָם מְעָרֶבֶת לוֹ שֶׁלֹּא מִדַּעְתּוֹ, אֲפִלּוּ אִם מִחָה בָּהּ שֶׁלֹּא לְעָרֵב, וַאֲפִלּוּ אֵין רָגִיל לְעָרֵב עִמָּהֶם. וְהָנֵי מִילֵי כְּשֶׁאוֹסֵר עֲלֵיהֶם, כְּגוֹן שֶׁאֵין הַבַּיִת פָּתוּחַ אֶלָּא לְאוֹתוֹ חָצֵר; אֲבָל אִם הוּא פָּתוּחַ לִשְׁתֵּי חֲצֵרוֹת, בְּאַחַת רָגִיל לָצֵאת וְלָבֹא תָּדִיר שֶׁאוֹסֵר עֲלֵיהֶם, וּבְאַחַת אֵינוֹ רָגִיל לָצֵאת וְלָבֹא, בְּרָגִיל, שֶׁאוֹסֵר, מְעָרֶבֶת שֶׁלֹּא לְדַעְתּוֹ אֲפִלּוּ אֵינוֹ רָגִיל לְעָרֵב, וּכְשֶׁאֵינוֹ רָגִיל לָצֵאת וְלָבֹא נָמֵי אַף עַל פִּי שֶׁאֵין אוֹסֵר, אִם רָגִיל לְעָרֵב עִמָּהֶם מְעָרֶבֶת שֶׁלֹּא לְדַעְתּוֹ; אֲבָל אִם אֵינוֹ אוֹסֵר וְגַם אֵינוֹ רָגִיל לְעָרֵב עִמָּהֶם, אֵינָהּ מְעָרֶבֶת שֶׁלֹּא לְדַעְתּוֹ. וְכָל זְמַן שֶׁלֹּא מִחָה בָּהּ בְּפֵרוּשׁ, אֲפִלּוּ אִם אֵינוֹ רָגִיל לְעָרֵב עִמָּהֶם וְאֵינוֹ אוֹסֵר, מְעָרֶבֶת שֶׁלֹּא בִּידִיעָתוֹ דְּמִסְתָמָא נִיחָא לֵיהּ; אֲבָל אֵינָהּ יְכוֹלָה לְזַכּוֹת מִשֶּׁלּוֹ לַאֲחֵרִים שֶׁלֹּא בִּידִיעָתוֹ. וְאִם אֵין הַבַּעַל וְהָאִשָּׁה בָּעִיר, יְכוֹלִים בְּנֵי הַבַּיִת לְעָרֵב שֶׁלֹּא בִּידִיעָתוֹ אִם אֵין הַבַּיִת פָּתוּחַ אֶלָּא לְחָצֵר אַחַת; וַאֲפִלּוּ אִם הָיָה פָּתוּחַ לִשְׁתֵּי חֲצֵרוֹת, אִם הוּא רָגִיל לְעָרֵב לְאַחַת מֵהֶם מְעָרְבִין עָלָיו, אֲבָל אִם אֵינוֹ רָגִיל לֹא. אֲבָל בְּנֵי הֶחָצֵר אֵין יְכוֹלִים לִקַּח פִּתּוֹ מִבֵּיתוֹ לְעָרֵב שֶׁלֹּא מִדַּעַת אֶחָד מִבְּנֵי הַבַּיִת, אֲפִלּוּ רָגִיל עִמָּהֶם וְאוֹסֵר עֲלֵיהֶם. וְיֵשׁ אוֹמְרִים דְּאֵין אִשְׁתּוֹ מְעָרֶבֶת אֶלָּא שֶׁלֹּא בִּידִיעָתוֹ, אֲבָל אִם אוֹמֵר שֶׁאֵינוֹ רוֹצֶה לְעָרֵב עִמָּהֶם, לֹא. וְאִם הוּא רָגִיל לְעָרֵב עִמָּהֶם וְעַכְשָׁו אֵינוֹ רוֹצֶה, בְּנֵי חָצֵר נִכְנָסִים לְתוֹךְ בֵּיתוֹ וְנוֹטְלִים מִמֶּנּוּ בְּעַל כָּרְחוֹ. וְאִם אֵינוֹ רָגִיל אֵינָם יְכוֹלִים לִטֹּל מִמֶּנּוּ בְּעַל כָּרְחוֹ אֲבָל כּוֹפִין אוֹתוֹ בְּבֵית דִּין לְעָרֵב עִמָּהֶם אוֹ בֵּית דִּין יוֹרְדִין לִנְכָסָיו. הַגָּה: מִי שֶׁאֵינוֹ רָגִיל לְעָרֵב, וְעֵרֵב עִם בְּנֵי הֶחָצֵר וְחָזַר מֵעֵרוּבוֹ, צָרִיךְ לַחֲזֹר וּלְזַכּוֹת; אֲבָל אִם רָגִיל לְעָרֵב הָוֵי עֵרוּב בְּעַל כָּרְחוֹ (הָרֹא"שׁ פֶּרֶק הַדָּר).

A man's wife may make an eruv (the loaf set aside to join separate households into one for the Sabbath) for him without his consent, even if he protested to her that she should not make an eruv, and even if he is not accustomed to make an eruv with them. And this applies where he renders it forbidden to them — as where the house opens only to that courtyard. But if it opens to two courtyards, and in one he is accustomed to go in and out constantly, so that he renders it forbidden to them, and in the other he is not accustomed to go in and out: in the one he is accustomed to use, where he renders it forbidden, she makes an eruv without his consent even if he is not accustomed to make an eruv; and where he is not accustomed to go in and out, too, even though he does not render it forbidden, if he is accustomed to make an eruv with them she makes an eruv without his consent. But if he does not render it forbidden and is also not accustomed to make an eruv with them, she does not make an eruv without his consent. And so long as he has not protested to her expressly, even if he is not accustomed to make an eruv with them and does not render it forbidden, she makes an eruv without his knowledge, for presumably it pleases him; but she cannot grant a share of what is his to others without his knowledge. And if the husband and the wife are not in the town, the members of the household may make an eruv without his knowledge if the house opens only to one courtyard; and even if it opened to two courtyards, if he is accustomed to make an eruv with one of them they make the eruv for him, but if he is not accustomed, no. But the residents of the courtyard cannot take his bread from his house to make the eruv without the consent of one of the members of the household, even if he is accustomed to join them and renders it forbidden to them. And there are those who say that his wife may make an eruv only without his knowledge; but if he says that he does not wish to make an eruv with them, no. And if he is accustomed to make an eruv with them and now does not wish to, the residents of the courtyard enter his house and take from him against his will. And if he is not accustomed, they cannot take from him against his will, but they compel him through the court to make an eruv with them, or the court takes possession of his property. Hagah [Rema]: One who is not accustomed to make an eruv, and made an eruv with the residents of the courtyard and then withdrew from his eruv, must grant it again; but if he is accustomed to make an eruv, it is an eruv against his will (the Rosh, chapter "One who dwells").
