Se’if 1א׳

שור שנגח ומכרו מזיק או ניזק. ובו ד סעיפים: שור תם שהזיק אם מכרו המזיק עד שלא עמד בדין אע"פ שהוא מכור הרי הניזק גובה הימנו וחוזר הלוקח וגובה מהמזיק שמכר לו שכיון שנגח קול יש לו ולא היה לו ללוקח ליקח אותו עד שיגבה הניזק: הגה מכרו ניזק מכור וכשיתפסנו יקחנו הלוקח (טור ס"א):

An ox that gored, and the one who damaged or the one damaged sold it; it contains four se'ifim. An ox not forewarned that did damage: if the one who damaged sold it before he stood in judgment, even though it is sold, the one damaged collects from it, and the buyer goes back and collects from the one who damaged, who sold it to him; for since it gored, it has a report about it, and the buyer should not have taken it until the one damaged had collected. Hagah [Rema]: If the one damaged sold it, it is sold, and when he seizes it the buyer shall take it (Tur, se'if 1).

Se’if 2ב׳

שחטו מזיק גובה מבשרו (וי"א דצריך לשלם פחת השחיטה) (טור שם מהג"מ פ' המניח) וכן אם נשתמש בו חייב ליתן לניזק שכירות (טור וב"י בשם רש"י והראב"ד) נתנה במתנה מה שעשה עשוי ויגבה הניזק ממנו:

If the one who damaged slaughtered it, the one damaged collects from its meat (and some say that he must pay the loss in value caused by the slaughter) (Tur there, from Hagahot Mordechai, chapter "One who places"); and likewise, if he made use of it, he is obliged to give the one damaged its hire (Tur and Beit Yosef in the name of Rashi and the Raavad). If he gave it as a gift, what he did is done, and the one damaged collects from it.

Se’if 3ג׳

בד"א כשמכר או נתן קודם שעמד בדין אבל אם עמד בדין ואח"כ מכרו או נתנו במתנה לא עשה כלום:

When is this said? When he sold it or gave it before he stood in judgment; but if he stood in judgment and afterwards sold it or gave it as a gift, he has done nothing.
