Se’if 1א׳
אסור להזיק ממון חבירו ולא לגרו' שום היזק. ובו ט סעיפים: אסור להזיק ממון חבירו ואם הזיקו אע"פ שאינו נהנה חייב לשלם נזק שלם בין שהי' שוגג בין שהיה אנוס (ודווקא שאינו אנוס גמור כמו שיתבאר) כיצד נפל מהגג ושבר את הכלי או שנתקל כשהוא מהלך ונפל על הכלי ושברו חייב נזק שלם:
It is forbidden to damage one's fellow's property, or to cause any damage; it contains nine se'ifim. It is forbidden to damage one's fellow's property; and if he damaged it, even though he has no benefit, he is obliged to pay full damage — whether he was unwitting or whether it was by mishap (and specifically where it is not a complete mishap, as will be explained). How so? If he fell from the roof and broke the vessel, or stumbled while walking and fell on the vessel and broke it, he is liable for full damage.
Se’if 2ב׳
נפל מן הגג והזיק חייב לשלם נזק שלם בין שנפל ברוח מצויה בין שנפל ברוח שאינה מצוי' (דלא מקרי אונס גמור) (טור):
If he fell from the roof and did damage, he is obliged to pay full damage, whether he fell by an ordinary wind or by an unusual wind (for it is not called a complete mishap) (Tur).
Se’if 3ג׳
היה עולה בסולם ונשמטה שליב' מתחתיו ונפל והזיק אם לא היתה מהודקת בחזקה חייב ואם הית' חזקה ומהודקת ונשמטה או שהתליעה הרי זה פטור שזו מכה בידי שמים הוא וכן כל כיוצא בזה:
If he was going up a ladder, and a rung slipped out from under him, and he fell and did damage: if it was not firmly fixed, he is liable; and if it was strong and firmly fixed and slipped out, or it had become worm-eaten, he is exempt, for this is a blow from the hands of Heaven; and likewise in every similar case.
