הלכות אונאה ומקח טעותOna'ah· siman 232
Se’if 1א׳
המוכר דבר במדה ובמשקל וטעה או שטעה במנין המעות ומוכר דבר ונמצא בו מום. ובו כג סעיפים: המוכר לחבירו במדה במשקל או במנין וטעה בכל שהוא חוזר לעולם שאין אונאה אלא בדמים אבל בחשבון חוזר כיצד מכר לו מאה אגוזים בדינר ונמצא ק"א או צ"ט נקנה המקח ומחזיר הטעות ואפי' אחר כמה שנים וכן אם נמצא המעות חסר או יתר מהמנין שפסקו חוזר ואפי' לאחר שקנו מידו שלא נשאר לו אצל חבירו כלום חוזר שקנין בטעות הוא:
One who sells a thing by measure or by weight and erred, or who erred in the counting of the money, and one who sells a thing and a defect is found in it; it contains twenty-three se'ifim. One who sells to his fellow by measure, by weight or by number, and erred by any amount — it goes back for ever; for overreaching applies only to price, but in a reckoning it goes back. How so? He sold him a hundred nuts for a dinar, and they were found to be a hundred and one, or ninety-nine — the sale is acquired, and he returns the error, even after several years. And likewise if the money was found short of, or over, the number that they settled, it goes back; and even after they made a kinyan (a formal act of acquisition) from him that nothing remained owing to him from his fellow, it goes back, for it is a kinyan in error.

המקבל מעות מחבירו בין שהם במכר בין בהלואה בין בפרעון ומצא יתרון במעות אפילו אם לא תבעו חייב להחזיר אם הוא בכדי שהדעת טועה דהיינו שאם יש לחלק המעות העודפות להוציאם עשרה עשרה או חמשה חמשה ואין אחת או שתים עודפות שאינן באות לכלל חמש י"ל שטעה בחשבונו אם הם עשיריות טעה בין חמשים לארבעים או בין ארבעים לשלשים ואם הם חמישיות יש שרגילים למנות ה' ה' ואם היו נ"ה טעה בעשיריות כמו שנתבאר ובחמש העודפות טעה בין שלשה חמישיות לארבע ואם עודפות ט"ו או כ"ה טעה ג"פ או חמש פעמים בחמישיות אבל אם עודפות על החמישיות אחת או שתים או שלשה או ארבעה שאין מגיעות לחמש כולם מתנה ובלבד שהמעות יתרים שמצא לא יהיו במנין החמישיות או העשיריות שאם היה במנינם חייב להחזיר לו שמא האחרים שהיה מונה בהם החמישיות או עשיריות נתערבו עמהם: הגה ובמקום שרגילים למנות אחת אחת או שנים שנים וכיוצא בזה מקרי שהדעת טועה לפי המנהג שרגילי' למנות (המ"מ):
One who receives money from his fellow, whether by a sale, or by a loan, or in payment, and found an excess in the money — even if the other did not claim it, he must return it if it is within the measure in which the mind errs. That is: if the excess coins can be divided so as to be counted out ten at a time or five at a time, and there is not one or two over that do not come to a total of five, one may say that he erred in his counting. If they are tens, he erred between fifty and forty, or between forty and thirty; and if they are fives — for there are those who are accustomed to count five at a time — if they were fifty-five, he erred in the tens, as was explained, and in the five that are over he erred between three fives and four; and if fifteen or twenty-five are over, he erred three times or five times in the fives. But if there are over, beyond the fives, one or two or three or four, which do not reach five, all of them are a gift; provided that the excess coins that he found are not within the count of the fives or the tens, for if they were within their count he must return it to him, lest the others with which he was counting the fives or the tens got mixed in with them. Hagah [Rema]: And in a place where they are accustomed to count one at a time, or two at a time, and the like, it is called "the mind errs" according to the custom by which they are accustomed to count (the Maggid Mishneh).
Se’if 3ג׳
המוכר לחבירו קרקע או עבד או בהמה או שאר מטלטלין ונמצא במקח מום שלא ידע בו הלוקח מחזירו אפי' לאחר כמה שנים שזה מקח טעות הוא והוא שלא ישתמש במקח אחר שידע במום אבל אם נשתמש בו אחר שראה המום ה"ז מחל ואינו יכול להחזיר:
One who sells his fellow land, or a slave, or an animal, or other movables, and a defect was found in the goods of which the buyer did not know — he returns it, even after several years, for this is a mistaken sale; provided that he did not use the goods after he knew of the defect. But if he used it after he saw the defect, he has waived it and cannot return it.
