Halacha 1א׳
אֵלוּ מְטַמְּאִין בְּמַגָּע וּבְמַשָּׂא וּבְאֹהֶל. הַמֵּת אֲפִלּוּ נֵפֶל שֶׁלֹּא נִתְקַשְּׁרוּ אֵיבָרָיו בְּגִידִין. וּכְזַיִת מִבְּשַׂר הַמֵּת. וּכְזַיִת נֶצֶל. וְאֵיבָר מִן הַחַי. וְאֵיבָר מִן הַמֵּת שֶׁיֵּשׁ עֲלֵיהֶם בָּשָׂר כָּרָאוּי. וְהַשִּׁדְרָה וְהַגֻּלְגּלֶת. וְרֹב בִּנְיָנוֹ וְרֹב מִנְיָנוֹ. וְרֹבַע עֲצָמוֹת מִכָּל מָקוֹם אַף עַל פִּי שֶׁאֵין בָּהֶן לֹא רֹב בִּנְיָן וְלֹא רֹב מִנְיָן. וּרְבִיעִית דַּם. וּרְבִיעִית דַּם תְּבוּסָה. הַכּל שְׁתֵּים עֶשְׂרֵה:
These convey impurity by contact, by carrying and by a tent: a corpse, even a miscarried fetus whose limbs have not been knit together with sinews; an olive's bulk of a corpse's flesh; an olive's bulk of putrefied flesh; a limb from a living person; a limb from a corpse that has upon it the requisite flesh; the spinal column and the skull; the greater part of the frame and the greater part of the number; a quarter-kab of bones from any source, even though they comprise neither the greater part of the frame nor the greater part of the number; a quarter-log of blood; and a quarter-log of commingled blood. In all, twelve.
Halacha 2ב׳
וְאֵלּוּ מְטַמְּאִין בְּמַגָּע וּבְמַשָּׂא וְאֵין מְטַמְּאִין בְּאֹהֶל. אֵיבָר מִן הַחַי שֶׁחָסַר בְּשָׂרוֹ וְאֵין בּוֹ לְהַעֲלוֹת אֲרוּכָה. וְאֵיבָר מִן הַמֵּת שֶׁחָסַר בְּשָׂרוֹ אוֹ עַצְמוֹ וְלֹא נִשְׁאַר בָּשָׂר כְּדֵי לְהַעֲלוֹת אֲרוּכָה אוֹ שֶׁחָסַר הָעֶצֶם אַף עַל פִּי שֶׁיֵּשׁ עָלָיו בָּשָׂר כְּדֵי לְהַעֲלוֹת אֲרוּכָה. וְהַשִּׁדְרָה שֶׁחָסְרָה וְאֵין בָּהּ רֹבַע עֲצָמוֹת. וְהַגֻּלְגּלֶת שֶׁחָסְרָה וְאֵין בָּהּ רֹבַע עֲצָמוֹת. וְעֶצֶם אֲפִלּוּ כִּשְׂעוֹרָה. וְאֶרֶץ הָעַכּוּ"ם. וּבֵית הַפְּרָס. הַכּל שֶׁבַע:
And these convey impurity by contact and by carrying and do not convey impurity by a tent: a limb from a living person whose flesh is deficient and which has not enough to heal over; a limb from a corpse whose flesh or whose bone is deficient, so that there does not remain flesh enough to heal over, or whose bone is deficient even though there is upon it flesh enough to heal over; a spinal column that is deficient and in which there is not a quarter-kab of bones; a skull that is deficient and in which there is not a quarter-kab of bones; a bone, even the size of a barley-corn; the land of the gentiles; and a beit ha-peras. In all, seven.
Halacha 3ג׳
הַגּוֹלֵל וְהַדּוֹפֵק מְטַמְּאִין בְּמַגָּע וּבְאֹהֶל כְּקֶבֶר וְאֵינָן מְטַמְּאִין בְּמַשָּׂא. הָרֶקֶב מְטַמֵּא בְּמַשָּׂא וּבְאֹהֶל וְאֵינוֹ מְטַמֵּא בְּמַגָּע. טֻמְאַת רֹבַע עֲצָמוֹת בְּאֹהֶל וְטֻמְאַת רְבִיעִית דָּם וְטֻמְאַת אֵיבָר שֶׁאֵין עָלָיו בָּשָׂר כָּרָאוּי בֵּין מִן הַמֵּת בֵּין מִן הַחַי יֵרָאֶה לִי שֶׁכֻּלָּן טֻמְאָתָן אֵינָן דִּין תּוֹרָה שֶׁהֲרֵי אֵין הַנָּזִיר מְגַלֵּחַ עֲלֵיהֶן כְּמוֹ שֶׁבֵּאַרְנוּ בִּנְזִירוּת וְאֵין חַיָּבִין עֲלֵיהֶן עַל בִּיאַת הַמִּקְדָּשׁ. וְעַל טָמֵא בְּטֻמְאָה שֶׁל תּוֹרָה חַיָּב עַל בִּיאַת הַמִּקְדָּשׁ. לְפִיכָךְ אֲנִי אוֹמֵר שֶׁכָּל טֻמְאָה מִן הַמֵּת שֶׁאֵין הַנָּזִיר מְגַלֵּחַ עָלֶיהָ אֵינָהּ דִּין תּוֹרָה:
The golel and the dofek convey impurity by contact and by a tent, like a grave, and they do not convey impurity by carrying. Mould conveys impurity by carrying and by a tent, and does not convey impurity by contact. As for the impurity of a quarter-kab of bones by a tent, and the impurity of a quarter-log of blood, and the impurity of a limb that has not the requisite flesh upon it, whether from a corpse or from a living person — it appears to me that the impurity of all of them is not Torah law, since a nazirite does not shave on their account, as we have explained in the Laws of Naziriteship, and one is not liable for them on account of entering the Sanctuary; whereas for one who is impure with an impurity of the Torah, one is liable for entering the Sanctuary. Therefore I say that every corpse-impurity for which a nazirite does not shave is not Torah law.
