Se’if 1א׳
כָּל עִיר שֶׁיֵּשׁ בָּהּ יִשְׂרָאֵל, חַיָּבִים לְהַעֲמִיד מֵהֶם גַבָּאֵי צְדָקָה אֲנָשִׁים יְדוּעִים וְנֶאֱמָנִים, שֶׁיִּהְיוּ מְחַזְּרִים לִגְבּוֹת מִכָּל אֶחָד מַה שֶּׁהוּא רָאוּי לִתֵּן וְדָבָר הַקָצוּב עָלָיו, וְהֵם מְחַלְקִים הַמָּעוֹת מֵעֶרֶב שַׁבָּת לְעֶרֶב שַׁבָּת, וְנוֹתְנִים לְכָל עָנִי מַה שֶּׁיַּסְפִּיק לוֹ לְשִׁבְעָה יָמִים, וְזוֹ הִיא הַנִּקְרֵאת קֻפָּה. וְכֵן מַעֲמִידִים גַבָּאִים שֶׁלוֹקְחִים בְּכָל יוֹם וָיוֹם מִכָּל חָצֵר וְחָצֵר פַּת וּמִינֵי מַאֲכָל אוֹ פֵּרוֹת אוֹ מָעוֹת מִמִּי שֶׁמִּתְנַדֵּב לְפִי שָׁעָה, וּמְחַלְקִין אֶת הַגִבּוּי לָעֶרֶב בֵּין הָעֲנִיִּים, וְנוֹתְנִים מִמֶּנּוּ לְכָל עָנִי פַּרְנָסַת יוֹמוֹ, וְזֶהוּ הַנִּקְרָא תַּמְחוּי. מֵעוֹלָם לֹא רָאִינוּ וְלֹא שָׁמַעְנוּ קָהָל מִיִּשְׂרָאֵל שֶׁאֵין לָהֶם קֻפָּה שֶׁל צְדָקָה, אֲבָל תַּמְחוּי יֵשׁ מְקוֹמוֹת שֶׁלֹּא נָהֲגוּ בּוֹ. הַגָּה: וְלָכֵן מִי שֶׁיֵּשׁ לוֹ מְזוֹן שִׁבְעָה יָמִים, לֹא יִקַּח מִן הַקֻּפָּה וּמִי שֶׁיֵּשׁ לוֹ מְזוֹן יוֹם אֶחָד, לֹא יִקַּח מִן הַתַּמְחוּי, כְּמוֹ שֶׁנִּתְבָּאֵר לְעֵיל סִימָן רנ"ג. וּצְרִיכִים הַגַּבָּאִים שֶׁיִּהְיוּ נֶאֱמָנִים וַחֲכָמִים וִידַקְדְּקוּ עַל הָעֲנִיִּים שֶׁלֹּא יִהְיוּ רַמָּאִים. וְכָל שֶׁהַגַּבַּאי אֵינוֹ נֶאֱמָן, אָסוּר לִתֵּן צְדָקָה עַל יָדוֹ (הַכֹּל בָּטּוּר).
Every city in which there are Israelites is obliged to appoint from among them charity collectors, men known and trustworthy, who shall go round collecting from each one what he ought to give and the sum assessed upon him; and they distribute the money from Sabbath eve to Sabbath eve, and give to each poor man what suffices him for seven days; and this is what is called the kupah. And likewise they appoint collectors who take every single day from every courtyard bread and kinds of food, or fruit, or money, from whoever donates for the hour, and distribute what was collected in the evening among the poor, and give from it to each poor man his sustenance for his day; and this is what is called the tamchui. Never have we seen or heard of a community of Israelites that has no kupah of charity; but the tamchui — there are places where they are not accustomed to it. Hagah [Rema]: And therefore one who has food for seven days shall not take from the kupah, and one who has food for one day shall not take from the tamchui, as was explained above, siman 253. And the collectors must be trustworthy and wise, and must scrutinise the poor so that they are not swindlers. And any collector who is not trustworthy — it is forbidden to give charity through his hand (all of it in the Tur).
Se’if 2ב׳
בְּתַעֲנִית מְחַלְקִים מְזוֹנוֹת לַעֲנִיִּים. וְכָל תַּעֲנִית שֶׁאָכְלוּ הָעָם וְלָנוּ וְלֹא חִלְקוּ צְדָקָה לַעֲנִיִּים, הֲרֵי אֵלוּ כְּשׁוֹפְכֵי דָּמִים. בַּמֶּה דְּבָרִים אֲמוּרִים, כְּשֶׁלֹּא נָתְנוּ לָהֶם הַפַּת וִהַפֵּרוֹת, אֲבָל אִם אִחֲרוּ הַמָּעוֹת אוֹ הַחִטִּים אֵינָם כְּשׁוֹפְכֵי דָּמִים.
On a fast day they distribute food to the poor. And any fast day on which the people ate and lodged overnight, and did not distribute charity to the poor — these are as shedders of blood. In what case are these words said? When they did not give them the bread and the fruit; but if they delayed the money or the wheat, they are not as shedders of blood.
Se’if 3ג׳
ֹ הַקֻפָּה אֵינָהּ נִגְבֵּית בְּפָחוֹת מִשְּׁנַיִם, שֶׁאֵין עוֹשִׂים שְׂרָרָה עַל הַצִּבּוּר בְּמָמוֹן בְּפָחוֹת מִשְּׁנַיִם. אֲבָל לְאַחַר שֶׁנִּגְבֵּית, אֶחָד נֶאֱמָן עָלֶיהָ לִהְיוֹת גִזְבָּר. וְכֵן יְכוֹלים לְמַנּוֹת שְׁנֵי אַחִים לִהְיוֹת גִזְבָּרִים. וְאֵינָהּ מִתְחַלֶקֶת אֶלָא בִּשְׁלֹשָׁה, לְפִי שֶׁהוּא כְּדִינֵי מָמוֹנוֹת לְעַיֵּן עַל כָּל עָנִי וְעָנִי כַּמָּה רָאוּי לִתֵּן לוֹ. וְתַמְחוּי, כְּמוֹ שֶׁמִּתְחַלֶקֶת בִּשְׁלֹשָׁה כָּךְ אֵינָהּ נִגְבֵּית אֶלָא בִּשְׁלֹשָׁה, לְפִי שֶׁאֵינוֹ דָּבָר קָצוּב, וּצְרִיכִים לְעַיֵּן עַל כָּל אֶחָד וְאֶחָד כַּמָּה רָאוּי שֶׁיִּתֵּן.
The kupah is not collected by fewer than two, for one does not set up authority over the congregation in matters of money with fewer than two. But after it has been collected, one is trusted over it to be treasurer. And likewise they may appoint two brothers to be treasurers. And it is distributed only by three, since it is like monetary cases, to consider regarding each and every poor man how much is fitting to give him. And the tamchui — just as it is distributed by three, so it is collected only by three, since it is not a fixed sum, and they must consider regarding each and every one how much it is fitting that he give.
