Se’if 1א׳
כָּל אָדָם חַיָּב לִתֵּן צְדָקָה, אֲפִלּוּ, עָנִי הַמִּתְפַּרְנֵס מִן הַצְּדָקָה חַיָּב לִתֵּן מִמַּה שֶּׁיִּתְּנוּ לוֹ. וּמִי שֶׁנּוֹתֵן פָּחוֹת מִמַּה שֶּׁרָאוּי לִתֵּן, בֵּית דִּין כּוֹפִין אוֹתוֹ וּמַכִּין אוֹתוֹ מַכַּת מַרְדוּת עַד שֶׁיִּתֵּן מַה שֶּׁאֲמָדוּהוּ לִתֵּן, וְיוֹרְדִים לִנְכָסָיו בְּפָנָיו וְלוֹקְחִין מִמֶּנּוּ מַה שֶּׁרָאוּי לוֹ לִתֵּן.
Every person if obligated to give charity, even a pauper who is reliant on charity is obligated to give from what is given to him. One who gives less than what is fit for (him) to give, the court would force him and whip him lashes of rebellion until he gives what they evaluated he should give. They go to his property in his presence and take what is fit for him to give.
Se’if 2ב׳
מְמַשְׁכְּנִים עַל הַצְּדָקָה, אֲפִלּוּ בְּעֶרֶב שַׁבָּת.
They take a pledge for charity, even on the eve of the Sabbath.
Se’if 3ג׳
יְתוֹמִים, אֵין פּוֹסְקִין עֲלֵיהֶם צְדָקָה, אֲפִלּוּ לְפִדְיוֹן שְׁבוּיִים, אֲפִלּוּ יֵשׁ לָהֶם מָמוֹן הַרְבֵּה, אֶלָּא אִם כֵּן פּוֹסְקִין עֲלֵיהֶם לִכְבוֹדָם, כְּדֵי שֶׁיֵּצֵא לָהֶם שֵׁם. הַגָּה: וְדַוְקָא צְדָקָה שֶׁאֵין לָהּ קִצְבָּה, אוֹ שֶׁיֵּשׁ לָהּ קִצְבָּה עַל נִכְסֵי יְתוֹמִים וִיכוֹלִין לְהַמְתִּין עַד שֶׁיִּגְדְּלוּ, כְּגוֹן שֶׁיֵּשׁ לָהֶם טֶבֶל וְאֵינָן צְרִיכִין לֶאֱכֹל עַכְשָׁו. אֲבָל אִם צְרִיכִים לֶאֱכֹל עַכְשָׁו, מְעַשְּׂרִין וְתוֹרְמִין לָהֶם. וְהוּא הַדִּין בִּצְדָקָה שֶׁיֵּשׁ לָהּ קִצְבָּה, כְּגוֹן שֶׁהָיוּ לָהֶם קְרוֹבִים עֲנִיִּים וְהָיָה לָהֶם קִצְבָּה מֵאֲבִיהֶם כָּל שָׁנָה וְשָׁנָה, וְאֵין לָהֶם לֶאֱכֹל רַק זוֹ אוֹ יְחַזְּרוּ עַל הַפְּתָחִים וְיִהְיֶה גְּנַאי לַיְתוֹמִים, הָאַפּוֹטְרוֹפּוֹס שֶׁלָּהֶם נוֹתֵן מִנִּכְסֵיהֶם הַקְצָבָה לִקְרוֹבֵיהֶם (תְּשׁוּבַת ר"י מִינְץ סִימָן א').
Orphans — they do not assess charity upon them, even for the redemption of captives, even if they have much money, unless they assess it upon them for their honour, so that a name may go out for them. Hagah [Rema]: And this is specifically charity that has no fixed allotment, or that has a fixed allotment upon the property of orphans and they are able to wait until they grow up — for instance, where they have tevel (produce from which the tithes have not been separated) and they do not need to eat now. But if they need to eat now, they separate the tithes and terumah for them. And the same law applies to charity that has a fixed allotment — for instance, where they had poor relatives and these had a fixed allotment from their father each and every year, and they have nothing to eat but this, or they would go begging from door to door and it would be a disgrace to the orphans — their guardian gives the allotment to their relatives from their property (a responsum of Mahari Mintz, siman 1).
