Se’if 1א׳
נְדָרִים אֵין חָלִין עַל דָּבָר שֶׁאֵין בּוֹ מַמָּשׁ. כֵּיצַד, אָמַר: קוּנָם שֶׁאֲנִי מְדַבֵּר עִמְּךָ, שֶׁאֲנִי עוֹשֶׂה לְךָ, שֶׁאֲנִי מְהַלֵּךְ לְךָ, שֶׁאֲנִי יָשֵׁן עִמְּךָ אֵינוֹ נֶדֶר; וְכֵן אִם אָמַר: דִּבּוּרַי וַעֲשִׂיָּתִי וַהֲלִיכָתִי אֲסוּרִים עָלֶיךָ וְשֵׁנָה אֲסוּרָה עָלַי, אֵינוֹ נֶדֶר; וּמִיהוּ מִדְּרַבָּנָן צָרִיךְ שְׁאֵלָה (פי' לִשְׁאֹל עַל נִדְרוֹ וְלִמְצֹא פֶּתַח לְהַתִּירוֹ). לְפִיכָךְ רְאוּבֵן הָאוֹסֵר עָלָיו שְׁמִיעַת תְּפִלַּת שִׁמְעוֹן, צָרִיךְ שְׁאֵלָה מִדְּרַבָּנָן; אֲבָל אִם אָמַר: קוּנָם פִּי מְדַבֵּר עִמְּךָ, קוּנָם יָדַי עוֹשׂוֹת לְךָ, קוּנָם רַגְלַי מְהַלְּכוֹת לְךָ, קוּנָם עֵינַי בַּשֵּׁנָה, הָוֵי נֶדֶר גָּמוּר מִן הַתּוֹרָה. וְכָל שֶׁכֵּן אִם אָמַר: יֵאָסֵר עָלֶיךָ פִּי לְדִבּוּרִי וְיָדַי לַעֲשִׂיָּתִי וְרַגְלַי לְהִלּוּכִי. הַגָּה: הָאוֹמֵר: דִּבּוּר פִּי עָלֶי ךָ אוֹ נְטִילַת אֶבֶן עָלַי, יֵשׁ אוֹמְרִים דְּהָוֵי נֶדֶר הוֹאִיל וְהִזְכִּיר הַפֶּה וְהָאֶבֶן (תא"ו ני"ד וְכֵן מַשְׁמָע בר"ן בְּשֵׁם התוס' שֶׁבְּבֵית יוֹסֵף סוֹף סִימָן רל"ט).
Vows do not apply to intangible substances. For example, if one says: "Konam that I speak to you!" or "serve you" or "go for you" or "sleep with you" - this is no vow. So too, if one phrases it this way: my speech, my servitude, or my going is forbidden to you, or sleep is forbidden to me - this is no vow. However, on a rabbinic level one should have these annulled. Therefore, if Reuben forbids himself from hearing Shimon's prayer, on a rabbinic level this should be annulled. Yet if he says "Konam is my mouth from speaking to you", "Konam is my hand from serving you", "Konam are my feet from walking for you", "Konam are my eyes for sleep" - these are all absolute Torah-level vows. All the more so if one says: "Forbidden to you is my mouth for my speech", "my hands for my work", "my feet for my walking". RAMA: There are those who say that the phrases: [Konam is] "The speech of my mouth to you" or "The lifting of the stone is to me" are a vow, since one has mentioned the [tangible objects] mouth and stone.
Se’if 2ב׳
הָאוֹמֵר: אֶשְׁנֶה פֶּרֶק זֶה, הָוֵי כְּאִלּוּ נָדַר לָתֵת צְדָקָה. אוֹ לַעֲשׂוֹת שְׁאָר מִצְוֹת וְנִדְרוֹ קַיָּם (וְכֵן מַשְׁמָע בַּטּוּר וְרֹא"שׁ וּפוֹסְקִים).
One who says: I shall study this chapter — it is as though he vowed to give charity, or to perform the rest of the mitzvot; and his vow stands (and so it is implied in the Tur and the Rosh and the poskim).
Se’if 3ג׳
אָמַר: קוּנָם עֵינַי בְּשֵׁנָה הַיּוֹם אִם אִישַׁן לְמָחָר, לֹא יִישַׁן הַיּוֹם שֶׁמָּא יִשְׁכַּח וְיִישַׁן לְמָחָר; אֲבָל אִם אָמַר: קוּנָם עֵינַי בְּשֵׁנָה לְמָחָר אִם אִישַׁן הַיּוֹם, יָכוֹל לִישַׁן הַיּוֹם וְלֹא חַיְשִׁינָן שֶׁמָּא לְמָחָר יִשְׁכַּח נִדְרוֹ וְיִישַׁן.
He said: konam (forbidden as an offering is) are my eyes as to sleep today, if I sleep tomorrow — he shall not sleep today, lest he forget and sleep tomorrow. But if he said: konam are my eyes as to sleep tomorrow, if I sleep today — he may sleep today, and we are not concerned lest tomorrow he forget his vow and sleep.
