כְּכָל מִשְׁפְּטֵי בִּטּוּל לְמִי שֶׁשָּׁכַח וְלֹא עֵרֵב בַּחֲצֵרוֹ, כֵּן הוּא בְּמָבוֹי. שֶׁאִם שָׁכְחָה חָצֵר אַחַת וְלֹא נִשְׁתַּתְּפָה, מְבַטֶּלֶת רְשׁוּתָהּ לִשְׁאָר בְּנֵי הַמָּבוֹי אוֹ הֵם לָהּ, אַף עַל פִּי שֶׁהֵם רַבִּים, שֶׁבְּנֵי הֶחָצֵר גַּבֵּי מָבוֹי חֲשׁוּבִים כְּיָחִיד בֶּחָצֵר. וּכְכָל מִשְׁפְּטֵי יִשְׂרָאֵל בֶּחָצֵר עִם הָעַכּוּ"ם, כֵּן הוּא בְּמָבוֹי אוֹ בָּעִיר, שֶׁאֵין אָסוּר לְטַלְטֵל בְּמָבוֹי אוֹ בְּעִיר הַמֻּקֶּפֶת חוֹמָה עַד שֶׁיִּהְיוּ שְׁתֵּי חֲצֵרוֹת שֶׁל בָּתֵּי יִשְׂרָאֵל בָּעִיר, אֲבָל חָצֵר אַחַת, לֹא, אֲפִלּוּ אִם הַרְבֵּה בָּתִּים שֶׁל יִשְׂרָאֵל פְּתוּחִים לְתוֹכָהּ; וְהוּא שֶׁתְּהֵא הָעִיר מֻקֶּפֶת חוֹמָה לַדִּירָה. וּסְתָם עֲיָרוֹת הֵן מֻקָּפוֹת לַדִּירָה. וּסְתָם מִבְצָרִים אֵינָם מֻקָּפִים לַדִּירָה. וּכְשֶׁיֵּשׁ ב' חֲצֵרוֹת שֶׁל בָּתֵּי יִשְׂרָאֵל בְּעִיר צְרִיכִים לִשְׂכֹּר מִכָּל חָצֵר וְחָצֵר שֶׁל עַכּוּ"ם, וְאֵין מַסְפִּיק בְּמַה שֶּׁיִּשְׁכֹּר מִשַּׂר הָעִיר. הַגָּה: וְיֵשׁ אוֹמְרִים דְּדַוְקָא לְעִנְיַן לְהוֹצִיא וּלְהַכְנִיס לִרְשׁוּת הָעַכּוּ"ם, אֲבָל לְטַלְטֵל בַּמָּבוֹי יָכוֹל לִשְׂכֹּר מִן הַשַּׂר שֶׁהֲרֵי דֶּרֶךְ הַמָּבוֹי הוּא שֶׁל הַשַּׂר וְיָכוֹל לְסַלֵּק כָּל הָעַכּוּ"ם מִשָּׁם. (ריב"ש סי' תכ"ז) בַּמֶּה דְּבָרִים אֲמוּרִים, בְּשַׂר שֶׁאֵין הַבָּתִּים שֶׁלּוֹ, וְגַם אֵין לוֹ רְשׁוּת לְהִשְׁתַּמֵּשׁ בְּבָתֵּי בְּנֵי הָעִיר כְּלָל, אֲפִלּוּ בִּשְׁעַת מִלְחָמָה, אֲבָל בִּמְקוֹם שֶׁכָּל צָרְכֵי הָעִיר אֵינָם נַעֲשִׂים אֶלָּא עַל פִּי הַשַּׂר אוֹ הַמְמֻנֶּה שֶׁלּוֹ, וַדַּאי שֶׁשְּׂכִירוּת מֵהַשַּׂר הַהוּא אוֹ מִשְּׂכִירוֹ וּלְקִיטוֹ מְהָנֵי, שֶׁהֲרֵי יֵשׁ לוֹ רְשׁוּת לְהוֹשִׁיב אֲנָשָׁיו וּכְלֵי מִלְחַמְתּוֹ בְּבָתֵּי בְּנֵי הָעִיר בִּשְׁעַת מִלְחָמָה שֶׁלֹּא מִדַּעְתָּם.
Laws of nullifying permission for those who forgot to make an eruv. Containing 2 paragraphs: Just as the laws of nullification apply to one who forgot and did not establish an eruv in his courtyard, so too in an alleyway — if one courtyard forgot and did not join in the shituf, it may nullify its domain to the other residents of the alleyway, or they may nullify theirs to it, even though they are many. For the residents of a courtyard are considered as a single individual with respect to the alleyway. And just as the laws governing Jews dwelling in a courtyard with non-Jews apply, so too in an alleyway or in a walled city. Carrying is not prohibited in an alleyway or walled city unless there are two courtyards of Jewish homes in the city. But one courtyard alone does not suffice, even if many Jewish homes open into it. This applies when the city is surrounded by a wall built for dwelling. Typical towns are walled for dwelling; typical fortresses are not walled for dwelling. When there are two courtyards of Jewish homes in the city, one must rent from each and every courtyard of non-Jews; it does not suffice to rent from the city official. >Rama: Some say this is only regarding bringing items in and out of the non-Jewish domain, but for carrying in the alleyway, one may rent from the official, since the alleyway belongs to the official and he can remove all the non-Jews from there. This applies to an official who does not own the houses and has no right to use the residents' homes, even in wartime. But where all the city's affairs are conducted only by the official or his appointee, renting from that official or his agent suffices, for he has the right to place his men and weapons in the residents' homes in wartime without their consent.

יִשְׂרָאֵלִים הַדָּרִים בְּחָצֵר יְחִידִי בְּעִיר שֶׁל עַכּוּ"ם שֶׁהִיא מֻקֶּפֶת חוֹמָה, וְעָבְרוּ יְהוּדִים אֲחֵרִים דֶּרֶךְ שָׁם בְּשַׁבָּת וְנִתְאַכְסְנוּ בְּחָצֵר אַחֶרֶת, אֵינָם אוֹסְרִים עֲלֵיהֶם דְּאוֹרֵחַ אֵינוֹ אוֹסֵר, וּמֻתָּרִים לְטַלְטֵל בְּכָל הָעִיר. וְעַיֵּן לְעֵיל סוֹף סי' ש"ע.
Jews dwelling alone in a courtyard in a non-Jewish walled city, when other Jews pass through on Shabbat and lodge in a different courtyard, do not prohibit them, for a guest does not prohibit. They are permitted to carry throughout the entire city. (See later Siman 370)
