דין מי שנמחק או אבד שטר חובו. ובו ד סעיפים: מי שבלה שטר חובו והרי הוא הולך להמחק מעמיד עליו עדים ובא לב"ד והם עושים לו קיום: הגה וי"א אפי' נמחק לגמרי מאחר שהעדים יודעים מה היה כתוב בו (טור בשם הרמב"ם [הרשב"ם] ונ"י פ' גט פשוט) ועדות זו שמעידין על השטר יכולים להעיד שלא בפני בעל הדבר (ר' ירוחם בשם הרשב"א) אבל עידי השטר עצמם אין כותבים לו שטר אחר אע"פ שנמחק בפניהם אבל באים לב"ד וב"ד עושים לו קיום כיצד מקיימים שטר זה כותבים שטר אחר ואומרים אנו ב"ד פלוני ופלוני ופלוני הוציא פלוני בן פלוני שטר נמחק לפנינו וזמנו ביום פלוני ופלוני ופלוני עדיו ואם כתבו והוזקקנו לעדותם של עדים ונמצאת מכוונת גובה בשטר זה שכתבו לו וא"צ קיום אחר ואם לא כתבו כן צריך להביא ראיה על העדים הראשונים עד שתתקיים עדותן (ע"כ לשון הרמב"ם): הגה ואם אינן מקיימים הוי כאלו הוציא עליו שטר שאינו מקויים (המגיד פכ"ג) ויש מי שאומר שצריך לכתוב בקיום שקרעו השטר הראשון דאל"כ פסול הוא דחיישינן שמא ילך לב"ד אחר ויעשו לו קיום אחר ויגבה ויחזור ויגבה אבל שטר מתנה שנמחק כותבים לו אחר אע"פ שלא נקרע הראשון: הגה וכותבין השטר מזמן הראשון ולא מזמן שכותבין לו ב"ד (ב"י בשם תוס') אבל אם היה במתנה אחריות וכן בשטרי מקח וממכר צריך לקרוע הראשון או לכתוב בשני שטר זה לא נכתב לטרוף בו ממשעבדי ולא מבני חרי אלא כדי להעמיד שדה זו ביד מקבל המתנה או הלוקח שלא יוציאנו מידו הנותן או המוכר:
The law of one whose document of debt was erased or lost; it contains four se'ifim. One whose document of debt has worn out and is on its way to being erased sets up witnesses for it and comes to the court, and they make a confirmation for him. Hagah [Rema]: And some say: even if it was erased entirely, since the witnesses know what was written in it (Tur in the name of the Rashbam, and Nimukei Yosef, chapter "A plain bill of divorce"); and this testimony that they give concerning the document may be given not in the presence of the party concerned (Rabbeinu Yerucham in the name of the Rashba). But the witnesses of the document themselves do not write him another document, even though it was erased before them; rather they come to the court, and the court makes a confirmation for him. How do they confirm this document? They write another document and say: We, the court — so-and-so, so-and-so and so-and-so: so-and-so son of so-and-so produced an erased document before us, and its date was such-and-such a day, and so-and-so and so-and-so were its witnesses. And if they wrote: and we attended to the testimony of the witnesses and it was found to be exact — he collects with this document that they wrote for him, and it needs no other confirmation; and if they did not write so, he must bring proof concerning the first witnesses until their testimony is confirmed (thus far the language of the Rambam). Hagah [Rema]: And if they do not confirm it, it is as though he produced against him a document that is not confirmed (the Maggid, chapter 23). And there is one who says that it must be written in the confirmation that they tore up the first document, for otherwise it is invalid, since we are concerned lest he go to another court and they make him another confirmation, and he collect and go back and collect again. But a document of gift that was erased — they write him another, even though the first was not torn up. Hagah [Rema]: And they write the document from the first date, and not from the date on which the court writes it for him (Beit Yosef in the name of the Tosafot). But if there was a liability in the gift, and likewise with documents of purchase and sale, the first must be torn up, or it must be written in the second: this document was not written to seize with it from encumbered property nor from unencumbered property, but only to establish this field in the hand of the recipient of the gift or of the buyer, so that the giver or the seller should not take it out of his hand.

מי שנמחק שטר חובו מעמיד עליו עדים לפני ב"ד ועושים לו קיומו ודוק' שיש עדים שנמחק באונס אבל מחקו מלוה מדעת או שהניחו במקום שאינו משתמר ונמחק אין עושים לו קיום דכיון שהניחו במקום שראוי להמחק ודאי פרעיה:
One whose document of debt was erased sets up witnesses for it before the court, and they make its confirmation for him. And this is specifically where there are witnesses that it was erased through mishap; but if the lender erased it deliberately, or left it in a place where it is not safeguarded and it was erased, they do not make a confirmation for him, for since he left it in a place fit to be erased, he has certainly been paid it.

מי שהיה לו שטר ואבד ובא לב"ד שיכתבו לו שטר אחר אין כותבין לו אפילו אם הביא עידי שטר הראשון ומעידים שכתבו ונתנו לו על כן אין לב"ד לכתוב העתקת שום שטר אם לא יראו שיש בו צורך כי ההיא דמי שנמחק שטר חובו ואם כתבו לאדם טופס שטר ובא לפני ב"ד אין ב"ד גובין בו עד שיוציא גוף השטר אם לא כתבו בו טעם למה עשו שטר אחר כי ההיא דנמחק שטר חובו וכיוצא בו כגון שידוע לעדים שאבד אבל אין ידוע לעדים לא יכתבו לו ואפילו נאבד בעדים אין כותבים לו דשמא ימצאנו אא"כ עדים מעידים שנשרף: הגה ודוקא בשטר הלואה אבל שטרי מקח ומתנה בלא אחריות כותבין לו אחר מאחר שנאבד אבל אין מטפיסין שום שטר ללא צורך (תשובת הרא"ש כלל ס"ח סי' י"ו וכ"א וכ"ג וכ"ז) שטר צוואה שכתוב בו מתנות לרבים ובא א' לב"ד שיכתבו לו לבדו חלקו במתנה כותבים לו דהא לאו לגוביינא קאי דהרי לאו שטרא הוא והיתומים יכולים למימר פרענו (תשובת הרשב"א סי' תתקע"ח ותשובת הרמב"ן סי' פ"ג) ומיהו אם היה ביד אחר ונאבד משם כותבים לו אחר דליכא למיחש שמא ימצאנו (תשו' הרשב"א סי' תתקע"ח וכפול לקמן ס"ס רנ"ג וע"ש ס"ב) כיון שלא היה בידו ואם הלוה במדה"י והמלוה חושש שלא יוליך שטרו בידו שמא יאבד לו בדרך יבא לב"ד וכותבין לו אחר והוא מניח שטרו ביד ב"ד שבעירו וב"ד שבמקום שהלוה שם יודיע לב"ד שבמקום המלוה שהוא נפרע מחובו וקורעים השטר הראשון שביד' ואם נאבד השטר שהטפיס כשהוא הולך לו אצל הלוה וידוע זה בעדים הולך לפני ב"ד ויעידו לפניהם שנאבד ויחזירו לו השטר שבידם: הגה (טור מבעה"ת) והוא מבעל העיטור אות ה' ד' ק"ז ע"ב וכל שטר שמטפיסין מעתיקין אותו אות באות משטר הראשון וכותבין בו שהוא העתק ואין צריכין בית דין להעתקת שטר אלא אפי' שני עדים יכולין להעתיקו (ואפילו הן קרובין זה לזה) (ריב"ש סי' תי"ג) (זהו הוספה מסמ"ע ואינו נכון כמ"ש בס"ק י"ח):
One who had a document and lost it, and came to the court that they should write him another document — they do not write it for him, even if he brought the witnesses of the first document and they testify that they wrote it and gave it to him. Therefore the court should not write a copy of any document unless they see that there is need of it, as in that case of one whose document of debt was erased. And if they wrote a man a copy of a document and it came before the court, the court does not collect with it until he produces the body of the document, if they did not write in it a reason why they made another document, as in that case of one whose document of debt was erased, and the like — for instance, where it is known to the witnesses that it was lost; but where it is not known to the witnesses, they should not write it for him. And even if it was lost before witnesses they do not write it for him, for perhaps he will find it — unless witnesses testify that it was burnt. Hagah [Rema]: And this is specifically with a document of a loan; but documents of purchase and of gift without liability — they write him another, since it was lost. But they do not copy any document without need (a responsum of the Rosh, klal 68, siman 16 and 21 and 23 and 27). A document of a will in which gifts to many are written, and one came to the court that they should write for him alone his share in the gift — they write it for him, for it does not stand for collection, since it is not a document of debt, and the orphans can say: we paid (a responsum of the Rashba, siman 978, and a responsum of the Ramban, siman 83). However, if it was in the hand of another and was lost from there, they write him another, for there is no concern lest he find it (a responsum of the Rashba, siman 978; and it is repeated below at the end of siman 253, and see there, se'if 2), since it was not in his hand. And if the borrower is overseas and the lender is concerned not to take his document in his hand, lest it be lost to him on the way, he comes to the court and they write him another, and he leaves his document in the hand of the court of his city; and the court in the place where the borrower is will inform the court in the lender's place that he has been paid his debt, and they tear up the first document that is in their hand. And if the document that was copied was lost as he was going to the borrower, and this is known through witnesses, he goes before the court and they testify before them that it was lost, and they return him the document that is in their hand. Hagah [Rema]: (Tur from the Baal haTerumot) And it is from the Baal haIttur, letter he, folio 107, side 2. And every document of which they make a copy, they copy it letter by letter from the first document and write in it that it is a copy; and a court is not needed for copying a document, but even two witnesses can copy it (and even if they are related to one another) (Rivash, siman 413) (this is an addition from the Sema and is not correct, as is written in se'if katan 18).
