דין הגונב כיס בשבת. ובו סעיף אחד: יש גנב שפטור מלשלם ואיזה זה שבא עם התשלומין חיוב מיתה כגון הגונב כיס בשבת ולא הגביהו ברשות הבעלים אלא היה מגררו ומוציאו מרשות הבעלים לרשות הרבים ואבדו שם: הגה אבל אם אבדו אח"כ חייב וכ"ש אם עדיין הוא בעין שחייב להחזירו (טור והמ"מ פ"ג דגנבה בשם י"מ ורמ"ה והרמב"ן ז"ל) וי"א שאם אינו בעין בכל ענין פטור מלשלם (המגיד פרק ג' דגניבה ובשם רש"י והרמב"ם) ה"ז פטור מתשלומין שאיסור שבת ואיסור גניבה והיזק באים כאחד אבל אם גנב כיס בשבת והגביהו שם ברשות היחיד ואח"כ הוציאו לרשות הרבי' והשליכו לנהר חייב לשלם שהרי נתחייב באיסור גניבה קודם שיתחייב באיסור סקילה וכן כל כיוצא בזה:

The law of one who steals a purse on the Sabbath; it contains one se'if. There is a thief who is exempt from paying. And which is this? One with whose payment there comes a liability of death — for example, one who steals a purse on the Sabbath, and did not lift it in the owner's domain, but was dragging it and brought it out of the owner's domain into the public domain, and lost it there. Hagah [Rema]: But if he lost it afterwards, he is liable; and all the more so, if it is still in existence, that he must return it (Tur and the Maggid Mishneh, chapter 3 of the Laws of Theft, in the name of some who explain, and the Ramah and the Ramban); and some say that if it is not in existence, he is exempt from paying in every case (the Maggid, chapter 3 of the Laws of Theft, and in the name of Rashi and the Rambam). This one is exempt from payments, for the prohibition of the Sabbath and the prohibition of theft and damage come together. But if he stole a purse on the Sabbath and lifted it there in the private domain, and afterwards brought it out into the public domain and threw it into the river, he is liable to pay; for he became liable under the prohibition of theft before he became liable under the prohibition that carries stoning; and likewise anything of this kind.
